Can Work Experience Be Questioned Even After a Reference Letter Is Submitted?

Providing an employment reference letter does not automatically mean that the claimed work experience will be accepted in a Canadian immigration application.

Immigration, Refugees and Citizenship Canada (IRCC) may review the reference letter together with the applicant’s stated position, job duties, payroll information, tax records and other employment evidence. IRCC identifies employment contracts, pay stubs, employer reference letters and tax documents as examples of evidence that may be used to establish employment or work experience.

When an officer has significant concerns about the authenticity or accuracy of the information provided, the applicant may receive a Procedural Fairness Letter and be given an opportunity to respond before a final decision is made.

Case Example: The Employment Was Genuine, but the Reference Letter Raised Concerns

An applicant had worked for an overseas company and obtained an employment reference letter for a permanent residence application. The employment itself was genuine, but the description of the applicant’s duties was general and some of the wording closely resembled the applicable National Occupational Classification description.

The employer was a small business with limited payroll and human-resources records. When the employment was later reviewed, the employer’s representative was also unable to clearly explain the applicant’s specific responsibilities. Before preparing a new explanation or requesting replacement documents, the applicant should review the complete application and the evidence already submitted. The correct facts should be established first, and only the documents necessary to support those facts should then be selected and explained.

A Procedural Fairness Letter is not itself a refusal. It provides an opportunity to respond to the officer’s concerns before a final decision is made. However, a response requires particular care when the letter raises possible misrepresentation. Under Canadian immigration law, a finding of misrepresentation may result in inadmissibility that generally continues for five years.

A general statement that the applicant genuinely worked for the employer, or that the employer prepared the letter incorrectly, may not be sufficient. The response should directly address the specific concerns identified by the officer and connect the explanation to the existing records.
