기존 전공이나 경력과 관련성이 낮은 과정을 선택하거나, 이미 취득한 학위보다 낮은 단계의 과정을 선택하거나, 비슷한 내용을 다시 공부하려는 경우에는 그 이유를 더욱 구체적으로 설명해야 합니다.

단순히 “캐나다 교육의 수준이 높다”, “영어실력을 향상하고 싶다” 또는 “더 좋은 직업을 얻고 싶다”는 일반적인 설명만으로는 신청인의 구체적인 학업 필요성을 충분히 보여주기 어려울 수 있습니다.

학업계획서는 좋은 표현을 많이 사용하는 문서가 아니라, 신청인의 과거 경력과 현재 선택, 향후 계획이 자연스럽게 연결된다는 점을 자료와 함께 설명하는 문서여야 합니다.

재정증명은 계좌잔액만 확인하는 문제가 아닙니다

학생비자 재정증명에서는 특정 날짜의 계좌잔액이 충분한지만 보는 것이 아닙니다.

신청인은 학비, 본인과 동반가족의 생활비 및 필요한 귀국 교통비 등을 부담할 수 있다는 점을 보여줘야 합니다. 동시에 그 자금이 어디에서 형성되었고 실제 학업에 사용할 수 있는 자금인지도 설명할 수 있어야 합니다.

재정자료를 검토할 때에는 다음 사항을 함께 확인해야 합니다.

  • 납부한 학비와 앞으로 납부해야 할 학비

  • 은행계좌의 일정 기간 거래내역

  • 신청인 또는 재정보증인의 소득

  • 재직 또는 사업 운영 사실

  • 자산의 형성과정

  • 장학금이나 교육비 지원

  • 동반가족에게 필요한 추가 비용

  • 최근 발생한 큰 금액의 입금

  • 대출금이나 일시적으로 빌린 자금의 포함 여부

신청 직전에 큰 금액이 입금되었다면 그 자금의 출처를 설명할 자료가 필요할 수 있습니다.

부모, 배우자 또는 다른 가족이 학비를 지원하는 경우에는 단순한 지원확인서만 제출하기보다 신청인과 지원자의 관계, 지원자의 소득과 자산, 지원금의 출처 및 실제 지원능력을 함께 보여주는 것이 중요합니다.

계좌잔액이 많더라도 자금의 형성과정이 불분명하거나 신청인의 전체 상황과 비교하여 합리적이지 않다면 추가적인 의문이 제기될 수 있습니다.

반대로 자료의 종류가 많다고 해서 반드시 충분한 것은 아닙니다. 각각의 자료가 누구의 자금인지, 어떤 비용을 부담하기 위한 것인지, 전체 학업기간 동안 재정계획이 어떻게 구성되는지를 이해할 수 있도록 정리해야 합니다.

PAL·TAL을 다시 받아야 하는지 확인해야 합니다

학생비자 신청에 Provincial Attestation Letter 또는 Territorial Attestation Letter가 필요한 신청인은 재신청 전에 PAL·TAL의 유효성을 반드시 확인해야 합니다.

이전 학생비자 신청이 승인되었거나 거절된 경우에는 원칙적으로 같은 PAL·TAL을 사용하여 다시 신청할 수 없으며, 새로운 유효한 PAL·TAL을 받아야 합니다.

새로운 신청은 이전 거절사유에 직접 답해야 합니다

학생비자 재신청에서는 이전 신청과 무엇이 달라졌는지가 분명하게 나타나야 합니다.

단순히 새로운 날짜로 신청서를 작성하거나 학업계획서의 표현을 조금 바꾸는 것만으로는 충분하지 않을 수 있습니다.

재신청 시기를 서두르지 않는 것이 중요합니다

학생비자 거절 후 반드시 일정 기간을 기다린 뒤에만 다시 신청해야 하는 것은 아닙니다. 결정서에 별도의 제한이 없다면 재신청은 가능할 수 있습니다.

그러나 재신청이 가능하다는 것과 즉시 다시 신청하는 것이 적절하다는 것은 다른 문제입니다.

English Summary

A refusal of a Canadian study permit does not necessarily prevent an applicant from applying again. Unless the refusal decision states otherwise, an applicant may generally submit a new application. However, reapplying immediately with substantially the same forms, explanations and supporting documents may result in the same concerns being raised again.

Before preparing a new application, the applicant should determine why the previous application was refused and whether the identified concerns can be addressed through clearer explanations, corrected information or additional supporting evidence.

Review the Refusal Letter and Officer Decision Notes

IRCC also provides officer decision notes with refusal letters for most temporary resident applications. These notes are written by the officer who made the final decision and may contain more specific reasons for the refusal.

For example, a refusal letter may state that the purpose of the visit was not consistent with a temporary stay. The officer’s notes may provide further detail, such as concerns about the relationship between the proposed program and the applicant’s previous education, the level of the program, the applicant’s employment history or the explanation provided in the study plan.

The refusal letter and the officer decision notes should therefore be reviewed together. The applicant should identify the specific concerns raised by the officer rather than relying only on the general refusal wording.

Officer decision notes are not necessarily the same as the complete immigration file. Depending on the circumstances, it may also be appropriate to consider whether additional records are required to understand the history of the application.

Review the Complete Previous Application

A proper reapplication review should not be limited to the refusal documents. The applicant should examine the complete previous submission, including application forms, the study plan, financial documents, educational records, employment evidence and information provided in earlier Canadian immigration applications.

Particular attention should be given to dates and answers concerning:

  • education and employment history

  • travel and residence history

  • family information

  • previous visa or permit refusals

  • sources of funds

  • the proposed program and career plans

Information in the new application should remain accurate and consistent with the previous record. Where an answer has changed, the applicant should determine whether the change resulted from an earlier error, omitted information or a genuine change in circumstances.

An unexplained difference between applications may create a new credibility concern even when the difference resulted from an innocent mistake. Any error or omission should therefore be corrected transparently and supported by an appropriate explanation.

Reassess the Purpose of Study

A letter of acceptance from a designated learning institution is an essential document, but it does not by itself establish that the study permit should be approved.

The application should explain why the applicant selected Canada, the particular institution and the proposed program. It should also show how the program relates to the applicant’s previous education, employment experience and realistic future plans.

A more detailed explanation may be required where the applicant:

  • is changing to a substantially different field

  • has already completed a similar program

  • is applying for a program below the level of previous studies

  • has a significant gap in education or employment

  • cannot obtain an obvious career benefit from the proposed course

General statements about the quality of Canadian education or a desire to improve English may not adequately explain why the particular program is necessary for the individual applicant.

The study plan should present a coherent connection between the applicant’s background, current educational choice and future objectives. Where possible, these explanations should be supported by educational, professional or industry-related evidence.

Review the Financial Evidence

Financial evidence involves more than showing a sufficient bank balance on a particular date.

The applicant must demonstrate the ability to pay the required tuition, living expenses and other relevant costs, including the expenses of accompanying family members where applicable. The evidence should also help explain the source, ownership and genuine availability of the funds.

The review may include:

  • tuition payment records

  • bank statements covering an appropriate period

  • employment and income evidence

  • business or asset documentation

  • scholarship or education funding

  • financial support from parents, a spouse or another sponsor

  • large or recent deposits

  • the overall cost of the proposed studies

Where a large amount was recently deposited, the application should include documents explaining its source. Where another person is providing support, the evidence should show the relationship to the applicant, the sponsor’s financial capacity and the nature of the commitment.

A large balance does not automatically resolve a financial concern if the source of the money is unclear or inconsistent with the applicant’s overall circumstances.

Confirm the PAL or TAL Requirements

Applicants who are required to submit a provincial attestation letter or territorial attestation letter should confirm whether a new document is required before reapplying.

A PAL or TAL used in a study permit application that was approved or refused generally cannot be reused for another application. In that situation, the applicant must obtain a new and valid PAL or TAL before submitting the reapplication.

The same PAL or TAL may be reusable in limited circumstances, such as where the previous application was voluntarily withdrawn before a final decision or was not accepted for processing, provided the document remains valid.

Applicants should confirm:

  • whether they are subject to the PAL or TAL requirement

  • whether the existing document remains valid

  • how the previous application was concluded

  • whether a new document must be issued

  • whether the institution or program has changed

  • whether an exemption applies

Applicants planning to study in Quebec should also review the applicable Québec Acceptance Certificate, or CAQ, requirements separately.

Address the Previous Refusal Directly

A new application should clearly show how it responds to the previous refusal.

This may involve correcting inaccurate information, adding omitted history, providing stronger financial documentation, clarifying the study plan or submitting a new PAL or TAL.

Changing the wording of the previous explanation without addressing the underlying concern may not be sufficient. The applicant should identify the issue raised by the officer and explain what new information, evidence or change in circumstances is being presented.

Different concerns require different forms of evidence. A concern about the purpose of study should be addressed through a coherent educational explanation and supporting records. A concern about finances should be addressed through objective evidence of income, assets and the source and availability of funds.

No single document or statement guarantees approval. The application is assessed as a complete record based on the applicant’s individual facts.

Review the Complete Record Before Reapplying

There is generally no mandatory waiting period before submitting another application unless the decision states otherwise. However, the ability to reapply does not mean that an immediate reapplication is always appropriate.

Before submitting a new application, the applicant should review the refusal letter, officer decision notes, previous forms, supporting documents, study purpose, financial evidence, immigration history and any required PAL, TAL or CAQ.

The new application should be accurate, internally consistent and directly responsive to the concerns identified in the previous decision.
