Among its immigration provisions, the legislation introduced new authorities allowing the Government of Canada to manage large groups of immigration applications and documents when action is considered necessary in the public interest.

It may also cancel, suspend or vary specified immigration documents, or impose and change conditions attached to those documents.

Similarly, a temporary resident visa or eTA is primarily a travel document and is not identical to a person’s temporary resident status inside Canada.
Nevertheless, a document action may create serious practical consequences.
A person may be unable to board a flight, may require another travel document, or may need to determine whether work or study can lawfully continue.
Could a work or study permit be affected?
Work permits and study permits are among the documents that may be covered by an order.
Where a measure affects people already in Canada, additional ministerial concurrence is required.
A person who receives notice that a work or study permit has been suspended, cancelled or varied should confirm:
the effective date of the measure;
whether the person may continue working or studying;
whether new conditions have been imposed;
whether another application is required;
whether travel outside Canada is affected; and
what information must be provided to an employer or educational institution.
A general news report should not be used as a substitute for the actual order and the person’s official notice.
Can permanent residence applications be terminated?
An Order in Council may cover specified applications for permanent resident visas.
This means that the processing of a defined group of pending permanent residence applications may potentially be suspended or terminated.
That is not the same as revoking the permanent resident status of someone who has already become a permanent resident.
The order must identify the relevant application group and the measure being taken.
Are refugee claims covered?
The group document and application authorities do not apply to in-Canada claims for refugee protection.
Bill C-12 introduced separate changes to asylum eligibility and processing, but those changes should not be confused with the group authorities governing immigration documents and related applications.
Are application fees automatically refunded?
Not necessarily.
The applicable Order in Council may specify whether fees will be repaid.
Where the processing of pending applications is terminated, the order must address whether the relevant fees will be returned.
Applicants should review:
whether their application is actually included;
whether processing has been suspended or terminated;
which fees are covered;
whether a separate refund request is required; and
how the refund will be issued.
Could document holders outside Canada be re-examined?
The legislation contains authority supporting the examination of document holders outside Canada for the purpose of implementing an order.
Depending on the applicable order and regulations, a person may be required to:
appear for an examination;
answer questions truthfully;
produce the immigration document;
provide relevant evidence; or
complete a medical examination.
These measures may be used to determine whether the person remains eligible or admissible and whether the document continues to meet the terms of the order.
Group powers and individual cancellation powers
Canada already had authority to cancel certain documents on an individual basis in prescribed circumstances.
Regulatory changes effective January 31, 2025 strengthened the authority of immigration and border officers to cancel temporary resident visas and eTAs, and in more limited situations, work and study permits.
Bill C-12 adds a broader mechanism for managing groups of applications and documents through an Order in Council.
The legislation also supports future regulations prescribing circumstances in which officers may take similar action case by case.
Applicants should therefore distinguish between:
an individual decision under existing regulations; and
a group measure made under a formal Order in Council.
How will the public know when the power is used?
An Order in Council made under these authorities must be made public through the Canada Gazette.
The Minister of Immigration must also report the action to Parliament and may be required to appear before a parliamentary committee.
A person concerned about a possible measure should check:
official IRCC announcements;
messages in the person’s IRCC account;
the published Order in Council;
the Canada Gazette; and
any implementation instructions.
Social-media posts and unofficial summaries may omit important limits, dates or exceptions.
What should current document holders do?
The enactment of Bill C-12 does not require every visa or permit holder to reapply.
Document holders should continue to monitor:
passport validity;
visa or eTA validity;
work or study permit conditions;
messages from IRCC;
material changes to employment, school enrolment or family circumstances;
official government orders; and
travel-document requirements before departure.
A person should not assume that a document has been cancelled unless the official measure applies to that document and individual.
What should applicants with pending files do?
Applicants should confirm:
that the application status remains active;
whether IRCC has sent a new message;
whether an additional-document deadline remains outstanding;
whether a formal Order in Council has been issued;
whether their application class and group are covered;
whether processing is paused or terminated; and
whether the order includes fee-repayment provisions.
A paused application should not be treated as a refusal unless the official notice says so.
A terminated application should also be distinguished from a refusal based on the applicant’s eligibility or admissibility.
Avoiding exaggerated interpretations
Bill C-12 gives the Government of Canada substantial new powers, but it is inaccurate to say that:
every visa can now be cancelled at any time for no reason;
the immigration minister can act alone;
cancellation of a visa automatically revokes permanent resident status;
all pending applications are about to be terminated;
fees will always be retained; or
every document holder must submit a new application.
The accurate position is that Canada now has a formal mechanism to manage defined groups of immigration documents and applications where action is considered necessary in the public interest.
Each use requires a separate formal decision, an identified scope and public disclosure.
Final point
Bill C-12 became law on March 26, 2026.
It allows the Government of Canada, through an Order in Council, to pause application intake, suspend or terminate the processing of specified pending applications and cancel, suspend or vary defined groups of immigration documents.
The authority may be used for public-interest matters such as fraud, administrative errors, public health, public safety or national security.
It is not a general power to revoke permanent or temporary resident status.
The most important question for an applicant or document holder is not merely whether the legal authority exists. It is whether an actual order has been issued and whether that order applies to the person’s specific document or application.
