3. 가장 중요한 것은 15일 또는 60일의 법정기한입니다

5. 어떤 경우에는 재신청이 더 맞을 수 있나요?

증빙이 실제로 부족했던 경우

A refusal of a Canadian visitor visa, study permit, work permit or permanent residence application does not always mean that the only option is to submit a stronger application again. If the refusal resulted from weak evidence or facts that can now be improved, reapplying may be the more practical route. If there is a serious concern about the fairness of the process or the legal reasonableness of the decision itself, however, an application for leave and judicial review in the Federal Court may need to be considered.
Key point: Judicial review is not a normal reapplication and the Federal Court does not simply reassess the visa application and issue a permit. The Court reviews whether the original immigration decision was made lawfully, reasonably and fairly. If the Court grants the judicial review, it may set aside the decision and send the matter back for a new determination.
1. Reapplication and judicial review solve different problems
A reapplication gives IRCC a new application with new or improved evidence. This can be appropriate when the first file did not adequately establish the purpose of travel, finances, study plan, employment situation, family ties or another factual requirement.
Judicial review is different. It is not primarily a process for adding documents that should have been submitted the first time. The Federal Court reviews the administrative decision and the process used to make it.
The first task after a refusal is therefore to identify the nature of the problem:
- Was important evidence genuinely missing?
- Was a material fact not explained clearly?
- Does the decision appear to misunderstand or fail to deal with key evidence that was actually submitted?
- Is there a potential procedural fairness issue?
- Is the concern simply disagreement with the result, or is there a legal issue that a lawyer should assess?
Different answers lead to different strategies.
2. Is judicial review the same as an appeal?
Not in the ordinary sense. Section 72 of the Immigration and Refugee Protection Act requires a person seeking judicial review of an immigration matter to first apply for leave, meaning permission from the Federal Court.
The Court process generally has two stages:
- Leave stage: The Court reviews the written materials and decides whether the case should proceed to a full judicial review hearing.
- Judicial review stage: If leave is granted, the Court hears the case and assesses the legality, reasonableness and procedural fairness of the original decision.
If leave is refused, the judicial review proceeding ends at that stage.

3. The 15-day or 60-day filing period can be critical
Section 72(2)(b) of the IRPA establishes short filing periods:
- 15 days for a matter arising in Canada
- 60 days for a matter arising outside Canada
The period runs from the day the applicant is notified of, or otherwise becomes aware of, the decision. A judge may extend the time for special reasons, but an extension is not automatic.
It can also be unsafe to assume that the deadline is determined simply by where the applicant is physically located. Federal Court practice materials recognize that determining whether a visa matter arose in or outside Canada can sometimes be less obvious than it appears.
For that reason, a person who may have a judicial review issue should not spend weeks preparing a reapplication and only later investigate the Court deadline. The correct deadline and litigation strategy should be confirmed promptly with a Canadian lawyer who is authorized to practise before the Federal Court.

4. Are Officer Decision Notes enough?
IRCC now provides Officer Decision Notes with refusal letters for most temporary resident applications and many permanent residence applications. These notes can be extremely helpful in understanding why an application was refused.
For Federal Court proceedings, however, IRCC currently instructs applicants to indicate that they have not received the reasons for refusal even if they received an Officer Decision Note. This allows the Court to request the complete reasons under Rule 9 and to determine whether information was removed from the decision note.

Officer Decision Notes are therefore an important starting point, but they should not automatically be treated as the complete Court record.
5. When might reapplying be more appropriate?
Reapplication can be more practical when the weakness can genuinely be corrected with better evidence.
For example, a visitor visa application may have contained weak financial evidence or an unclear travel purpose. A study permit application may not have explained the relationship between the proposed program and the applicant’s education or career. A work permit file may have been missing a required employment document.
Reapplication may also be more suitable where the facts have changed after the refusal, such as a new letter of acceptance, a new job offer, improved finances or a material change in personal circumstances.
A new application does not erase the previous refusal. The prior refusal must be disclosed accurately where required, and the new application should remain consistent with the factual record unless there is a clear explanation for any change.
6. When should judicial review be assessed quickly?
The following are not guarantees of success. They are examples of situations in which prompt legal review may be warranted.
The reasons appear inconsistent with important evidence in the file
If the application contained clear evidence on a central point but the refusal appears to proceed on a materially different factual premise, a lawyer may need to assess whether this is merely an evidentiary weakness or a reviewable problem with the decision.
There may be a procedural fairness issue
Whether an applicant should have received notice or an opportunity to respond to a particular concern is a fact-specific legal issue. It cannot be reduced to a simple rule that every concern requires a procedural fairness letter.
The concern is about the decision-making process itself
Judicial review is not based only on saying, “I qualified, so the visa should have been approved.” The central question is whether the administrative decision was made in a manner permitted by law. That is why it is important to distinguish a file that needs better evidence from a decision that may require legal review.
7. Does winning judicial review mean the visa is immediately approved?
No. The Federal Court does not normally issue the visitor visa, study permit, work permit or permanent resident visa itself.
If the Court concludes that the original decision cannot stand, the matter may be set aside and returned for reconsideration. The practical benefit is a lawful new determination, not an automatic immigration approval. The outcome of the new determination is not guaranteed.
8. Can an immigration consultant represent you in Federal Court?
The Federal Court’s official guidance is clear: in an immigration, refugee protection or citizenship judicial proceeding, a person may represent themselves or be represented by a lawyer who is a member in good standing of a Canadian law society. An immigration consultant or another non-lawyer generally cannot represent a person in Federal Court or provide legal advice about the Federal Court judicial process. Exceptional representation by a non-lawyer would require the Court’s permission in special circumstances.

- Record the date of the refusal and the date you received or became aware of it.
- Save the refusal letter and Officer Decision Notes.
- Compare the reasons with the full application, explanations and supporting documents that were submitted.
- Determine whether the problem is missing evidence, changed facts or a potential issue with the decision itself.
- If judicial review may be relevant, obtain lawyer review immediately rather than assuming that there is plenty of time.
- If reapplying, design the new application to answer the actual refusal reasons rather than merely resubmitting a larger volume of documents.
