캐나다에서 학교를 옮기면 PGWP가 안 나오나요? DLI 전학과 8개월 기준 정리

캐나다에서 컬리지나 대학을 다니다 다른 학교로 옮긴 학생들이 졸업을 앞두고 많이 묻는 질문이 있습니다.

“중간에 DLI를 바꿨는데 PGWP를 받을 수 있을까요?”

결론부터 보면, 학교를 한 번 옮겼다는 사실만으로 Post-Graduation Work Permit(PGWP) 자격이 자동으로 없어지는 것은 아닙니다.

하지만 전학 시점의 Study Permit 절차, 이전 학교와 새 학교의 DLI·PGWP 적격성, 실제 학업기간과 full-time status 등을 따로 확인해야 합니다. IRCC도 현재 PGWP 규정에서 학교 간 transfer를 별도로 다루고 있습니다.

전학 자체보다 중요한 것은 “어디에서, 어떤 프로그램을, 어떤 신분으로 얼마나 공부했는가”입니다.

지금은 기존 Study Permit으로 학교만 바꾸면 안 됩니다

캐나다의 post-secondary international student 규정은 이전과 달라졌습니다.

2024년 11월 8일부터 post-secondary DLI를 변경하려는 학생은 새 DLI에 맞는 Study Permit을 받아야 합니다.

캐나다 안에서 학교를 변경한다면 현재 permit의 extension을 신청하는 방식으로 새 Study Permit을 받아야 하고, 새 학교 역시 DLI여야 합니다.

새 학교에서 바로 수업을 시작할 수 있을까요?

일반적으로는 새 Study Permit이 승인된 뒤 새 DLI에서 공부해야 합니다.

IRCC가 인정하는 일부 예외는 있습니다. 예를 들어 기존 학교가 폐교하거나 프로그램이 중단되거나, DLI 지정을 잃는 등의 특정 상황에서는 application processing 중 새 학교에서 공부할 수 있는 경우가 있습니다.

따라서 단순히 “extension을 신청했으니 바로 새 학교로 가도 된다”고 생각해서는 안 됩니다.

학교를 옮겼다면 PGWP의 8개월 기준은 어떻게 보나요?

IRCC는 DLI와 DLI 사이를 전학한 경우에도 학업기간이 최소 8개월 이상이어야 PGWP 자격을 검토할 수 있다고 안내합니다.

다만 여기서 8개월이라는 숫자만 보는 것은 위험합니다.

PGWP는 기본적으로 다음을 함께 확인합니다.

  • 프로그램 자체가 PGWP 대상인지
  • 해당 DLI의 해당 프로그램이 PGWP eligible인지
  • 필요한 기간 동안 full-time student status를 유지했는지
  • Study Permit 조건을 준수했는지
  • 언어요건이나 field-of-study 요건이 적용되는 신청인인지
  • 졸업 후 정해진 신청기간 안에 신청했는지

즉, 여러 학교에서 공부한 기간을 단순히 달력상 합산해서 “8개월을 넘었으니 된다”고 판단해서는 안 됩니다.

non-DLI에서 시작했다가 DLI로 옮긴 경우는 더 주의해야 합니다

이 경우에는 규정이 더 명확합니다.

IRCC는 non-DLI에서 공부한 기간은 PGWP를 위한 학업기간으로 계산하지 않으며, DLI에서 공부한 기간만 계산한다고 안내합니다.

그리고 이 경우 DLI에서 최소 8개월을 공부해야 합니다.

예를 들어 non-DLI에서 5개월, 이후 PGWP eligible DLI에서 5개월을 공부했다고 해서 단순 합계 10개월만으로 8개월 요건을 충족했다고 볼 수는 없습니다.

PGWP 관점에서는 인정되는 DLI에서 보낸 기간을 따로 봐야 합니다.

새 학교가 DLI이면 무조건 PGWP가 가능한가요?

아닙니다.

DLI라는 것과 PGWP eligible program이라는 것은 같은 의미가 아닙니다.

IRCC도 “DLI를 졸업했다고 자동으로 PGWP 자격이 생기는 것은 아니다”라고 명확히 안내합니다. 학교뿐 아니라 실제 프로그램의 PGWP eligibility를 확인해야 합니다.

따라서 전학 전에는 새 학교의 이름만 확인할 것이 아니라:

  1. 새 학교가 현재 DLI인지
  2. 선택한 프로그램이 PGWP eligible인지
  3. 프로그램 기간이 PGWP 요건을 충족하는지
  4. 본인의 Study Permit 신청 시점에 적용되는 language requirement와 field-of-study requirement가 있는지

를 함께 확인하는 것이 중요합니다.

전학 과정에서 Study Permit 규정을 지키지 않았다면 왜 문제가 될까요?

학교 변경 규정은 단순 행정절차가 아닙니다.

IRCC는 기존 학교가 학생을 더 이상 enrolled 상태로 보고하지 않는데 학생이 permit에 맞지 않는 다른 학교에서 공부하면 Study Permit 조건 위반으로 판단될 수 있다고 안내합니다.

그 결과:

  • Study Permit이 무효가 될 수 있고
  • permit이 취소될 수 있으며
  • 캐나다에서 떠나거나 신분을 변경하라는 요구를 받을 수 있고
  • 향후 Study Permit 또는 Work Permit 신청에도 영향을 줄 수 있습니다.

PGWP 심사에서도 과거 학업과 Study Permit compliance는 중요한 문제가 될 수 있습니다.

2025년 이후 전학에서는 PAL/TAL도 다시 확인해야 합니다

2025년 1월 22일부터는 학교를 변경하면서 새 Study Permit을 신청할 때 일반적으로 새로운 PAL 또는 TAL이 필요합니다. 예외에 해당하는 경우는 별도로 확인해야 합니다.

따라서 새 LOA만 받아놓고 바로 전학하는 방식으로 진행해서는 안 됩니다.

전학 전에는 최소한 다음 순서를 확인하는 것이 좋습니다.

  1. 새 DLI와 프로그램 적격성 확인
  2. 새 Letter of Acceptance 확인
  3. 새 PAL/TAL 필요 여부 확인
  4. Study Permit extension 신청
  5. 새 DLI에서 공부를 시작할 수 있는 시점 확인
  6. 향후 PGWP 계산에 어떤 기간이 인정되는지 검토

졸업 후 PGWP는 언제까지 신청해야 하나요?

현재 IRCC 기준상 PGWP는 일반적으로 졸업 후 최대 180일 이내 신청해야 합니다.

하지만 “180일 이내면 아무 때나 괜찮다”는 의미는 아닙니다.

Study Permit 만료일과 졸업 확인일, 캐나다 내 현재 신분에 따라 restoration 또는 다른 신분 문제가 생길 수 있으므로 졸업 직전에 permit expiry와 신청시점을 함께 확인해야 합니다.

두 학교를 다닌 학생이 졸업 전에 확인할 자료

전학 이력이 있다면 PGWP 신청 전 다음 자료를 한 번에 놓고 비교하는 것이 좋습니다.

  • 이전 학교 LOA와 transcript
  • 새 학교 LOA와 transcript
  • 프로그램 시작일·종료일
  • Study Permit 및 extension 신청기록
  • 새 DLI로 변경한 시점
  • PAL/TAL이 적용된 경우 해당 자료
  • full-time enrolment를 확인할 수 있는 자료
  • authorized leave가 있었다면 학교 승인자료
  • 최종 completion letter
  • 언어시험 및 field-of-study 관련 증빙이 필요한 경우 해당 자료

특히 학교 사이에 공백이 있거나 part-time semester, authorized leave, 프로그램 변경이 있었다면 그 기간을 별도로 확인할 필요가 있습니다.

가장 중요한 결론

캐나다에서 학교를 옮겼다고 PGWP가 자동으로 거절되는 것은 아닙니다. 그러나 전학 과정이 Study Permit 규정에 맞았는지와 PGWP 적격 학업기간이 실제로 충족됐는지는 별개의 문제입니다.

DLI 사이를 옮긴 경우에는 최소 학업기간을 확인해야 하고, non-DLI에서 시작했다면 PGWP 계산에는 DLI에서 공부한 기간만 인정될 수 있습니다.

Does Changing Schools Affect Your PGWP in Canada? DLI Transfers and the 8-Month Rule Explained

Changing colleges or universities in Canada does not automatically make a student ineligible for a Post-Graduation Work Permit (PGWP).

The important questions are whether the student followed the study permit rules when changing DLIs, whether the schools and programs were PGWP-eligible, how much eligible study was completed, and whether the student continued to comply with the conditions of their study permit.

The key question is not simply whether you transferred. It is where, how and under what immigration status you completed your studies.

Do you need a new study permit when changing DLIs?

Yes, for post-secondary DLI changes.

Since November 8, 2024, a student cannot simply change post-secondary schools and continue using the same study permit for the new DLI.

A student in Canada generally needs to apply to extend the current study permit and obtain a new permit for the new DLI.

In most cases, the student must wait until that application is approved before beginning studies at the new school.

Limited exceptions apply where the previous DLI closed, discontinued the program, lost designated status or fell within other specific circumstances recognized by IRCC.

What happens to the PGWP 8-month requirement after a transfer?

IRCC specifically addresses transfers between schools.

Where a student transferred between DLIs, the qualifying length of studies must be at least eight months for PGWP eligibility to be considered.

However, the eight-month figure should not be considered in isolation.

A student must also review:

  • PGWP eligibility of the institution and program
  • full-time student status
  • compliance with study permit conditions
  • language requirements where applicable
  • field-of-study requirements where applicable
  • application timing after graduation

What if you transferred from a non-DLI to a DLI?

This is particularly important.

IRCC states that where a student transfers from a non-DLI to a DLI, only the time spent studying at the DLI counts.

The student must spend at least eight months studying at the DLI to qualify under this rule.

Therefore, studying five months at a non-DLI and five months at an eligible DLI should not simply be treated as ten months of PGWP-qualifying study.

Is every program at a DLI PGWP-eligible?

No.

Graduating from a designated learning institution does not automatically establish PGWP eligibility.

Students need to verify whether the specific program is PGWP-eligible and whether all other requirements apply to them.

Why does study permit compliance matter?

IRCC now requires students changing post-secondary DLIs to follow the new study permit procedure.

If the original school reports that a student is no longer enrolled and the student begins studying elsewhere without complying with the applicable rules, IRCC states that the student may be in breach of study permit conditions.

This can affect the current status and potentially future study or work permit applications.

Do students changing schools need a new PAL or TAL?

In most applicable cases, yes.

As of January 22, 2025, students changing schools generally need a new valid PAL or TAL before submitting the new study permit application, unless an exemption applies.

The transfer process should therefore be reviewed before starting classes at the new institution.

What documents should a transferring student review before applying for a PGWP?

A useful review normally includes:

  1. Letters of acceptance from both institutions.
  2. Transcripts from each school.
  3. Program start and completion dates.
  4. Study permits and extension applications.
  5. The effective date of the DLI change.
  6. PAL/TAL documents where applicable.
  7. Evidence of full-time studies.
  8. Documents concerning any authorized leave.
  9. The final completion letter and transcript.
  10. Language and field-of-study evidence where applicable.

How long after graduation can you apply?

IRCC currently allows eligible graduates up to 180 days after graduation to apply for a PGWP.

Students should nevertheless review the expiry date of their study permit and their immigration status rather than relying on the 180-day period alone.

Bottom line

A DLI transfer does not automatically eliminate PGWP eligibility, but an improperly handled transfer can create separate study permit and PGWP problems.

Students who moved between schools should reconstruct their academic and immigration timeline before applying: which institution they attended, whether each program was eligible, when the new study permit was requested or issued, and how much PGWP-qualifying study was actually completed.
