캐나다 Work Permit이 유효해도 TRV가 만료되면 출국 후 돌아올 수 있을까요?
캐나다에서 Work Permit을 가지고 일하는 분이 한국에 잠깐 다녀오려고 합니다.
Work Permit을 확인해 보니 아직 1년 가까이 남아 있습니다.
그래서 항공권을 예약하려다가 여권을 다시 펼쳐봤는데, 캐나다 비자 스티커에 적힌 Temporary Resident Visa(TRV)는 이미 만료되어 있습니다.
이럴 때 흔히 드는 생각이 있습니다.
“Work Permit이 아직 유효하니까 다시 캐나다에 들어오는 데 문제없는 것 아닌가요?”
그렇게 보면 안 됩니다.
Work Permit이 유효하다는 사실과 해외에서 캐나다로 다시 여행할 수 있다는 사실은 서로 다른 문제입니다.
Work Permit은 캐나다에서 일할 수 있는 권한과 조건을 정하는 문서이고, TRV는 비자가 필요한 국적의 외국인이 캐나다로 여행하여 입국을 요청할 때 사용하는 여행문서입니다.
IRCC도 Work Permit이나 Study Permit을 연장했다고 새 Visitor Visa가 자동으로 발급되는 것은 아니라고 명확하게 안내하고 있습니다.

Work Permit이 있는데 왜 TRV가 또 필요한가요?
캐나다 이민문서에서는 세 가지를 나눠서 이해하면 훨씬 쉽습니다.
1. 캐나다에서 체류할 수 있는 신분
Work Permit이나 Study Permit, Visitor Record 등은 캐나다 안에서 어떤 신분으로 얼마나 체류할 수 있는지를 판단할 때 중요합니다.
2. 캐나다에서 일하거나 공부할 수 있는 권한
Work Permit은 일정한 조건 아래 일할 수 있는 권한과 관련됩니다.
Study Permit은 일정한 조건 아래 공부할 수 있는 권한과 관련됩니다.
3. 해외에서 캐나다로 여행할 때 필요한 문서
비자가 필요한 국가의 국민이라면 일반적으로 TRV가 필요합니다.
비자면제 대상이라면 여행방식 등에 따라 eTA가 필요할 수 있습니다.
이 세 가지는 서로 연관되어 있지만 같은 문서가 아닙니다.
그래서 Work Permit이 유효하다고 해서 만료된 TRV까지 자동으로 살아나는 것은 아닙니다.
Work Permit을 연장했는데 왜 TRV는 자동으로 연장되지 않나요?
이 부분에서 특히 오해가 많습니다.
예를 들어 캐나다 안에서 Work Permit을 연장했고 새 Permit이 2027년까지 유효하게 발급됐다고 해보겠습니다.
하지만 여권에 붙어 있는 기존 TRV는 2026년 7월에 이미 만료되었습니다.
이 경우 새 Work Permit이 발급됐다는 사실만으로 새 TRV가 자동 발급되지는 않습니다.
IRCC는 Worker 또는 Student가 새 Visitor Visa가 필요하다면 별도의 TRV 신청을 해야 할 수 있다고 안내합니다.
즉,
- Work Permit 연장
- Study Permit 연장
- TRV 갱신
은 같은 절차가 아닙니다.
캐나다 안에서 새 TRV를 신청할 수 있나요?
일정한 조건을 충족하면 가능합니다.
IRCC는 현재 캐나다 안에 있는 Worker 또는 Student를 위한 별도의 Visitor Visa 신청 절차를 안내하고 있습니다.
현재 안내상 대표적으로 다음과 같은 상황을 검토합니다.
- 현재 캐나다에 있을 것
- 유효한 Study Permit 또는 Work Permit을 가지고 있을 것
- 가까운 시일 내 캐나다를 떠났다가 돌아올 계획이 있을 것
- 기존 Visitor Visa가 만료됐거나 곧 만료되는 등의 상황일 것
신청은 일반적으로 IRCC secure account를 통해 온라인으로 진행합니다.
여기서 재미있는 부분이 하나 있습니다.
캐나다 안에서 신청하더라도 document checklist에는 IMM 5257 — Application for Visitor Visa (Temporary Resident Visa) Made Outside of Canada라는 이름의 양식이 나타날 수 있습니다.
양식 이름 때문에 “나는 캐나다에 있는데 잘못된 양식 아닌가?”라고 생각할 수 있지만, IRCC는 캐나다 내 Worker/Student TRV 신청에서도 이 양식을 사용하도록 현재 안내하고 있습니다.
출국하기 바로 전에 신청하면 될까요?
권하지 않습니다.
TRV는 “캐나다 안에 체류하기 위한 허가”와는 다른 역할을 하기 때문에 해외여행 일정과 연결해서 생각해야 합니다.
예를 들어 다음과 같은 상황이 있을 수 있습니다.
- Work Permit은 2027년까지 유효
- TRV는 이미 만료
- 2주 뒤 한국 출국 예정
- 한 달 뒤 캐나다 직장 복귀 예정
이런 경우 여행을 먼저 확정한 뒤 TRV를 알아보기보다 현재 여행서류 상태부터 확인하는 편이 훨씬 안전합니다.
특히 새 TRV가 발급되기 전에 캐나다를 떠나면 캐나다 안에서 진행하던 신청과 여행계획이 예상대로 연결되지 않을 수 있습니다.
이미 캐나다를 떠난 뒤 TRV가 없다는 것을 알았다면요?
이 경우에는 캐나다 안에서 신청하는 절차와 동일하게 처리한다고 단정할 수 없습니다.
IRCC의 현재 안내는 이미 캐나다를 떠난 사람에게는 해외에서 Visitor Visa를 신청하는 절차를 따르도록 안내합니다.
그래서 출국 전에 확인하는 것이 중요합니다.
“일단 한국에 가서 신청하면 되겠지”라고 생각했다가 예상보다 처리기간이 길어지면 직장 복귀일, 학교 일정, 임대계약, 가족 일정까지 영향을 받을 수 있습니다.
TRV가 있으면 캐나다 입국이 보장되나요?
아닙니다.
이것도 중요한 부분입니다.
TRV는 캐나다로 여행하여 입국을 요청할 수 있도록 하는 여행문서이지만, 입국 자체를 보장하는 문서는 아닙니다.
최종적으로 캐나다 입국항에서 Border Services Officer가 입국요건 충족 여부를 판단할 수 있습니다.
Work Permit 연장 중 여행에 관한 IRCC의 현재 안내 역시 TRV 또는 eTA가 있더라도 재입국이 자동 보장되는 것은 아니라고 설명합니다.
Work Permit이 유효한 경우와 maintained status는 꼭 구분해야 합니다
여기부터는 조금 더 중요합니다.
“Work Permit이 유효하다”는 상황과 “Work Permit이 이미 만료됐지만 연장신청을 해서 maintained status로 일하고 있다”는 상황은 같지 않습니다.
예를 들어 현재 실제 Work Permit 자체가 2027년까지 유효하다면 한 가지 상황입니다.
반면 기존 Work Permit은 이미 만료됐고, 만료 전에 연장신청을 제출해서 IRCC 결정 전까지 maintained status로 캐나다에서 일하고 있다면 전혀 다른 상황입니다.
IRCC는 Work Permit 만료 전에 적절한 연장 또는 조건변경 신청을 제출한 경우, 일정한 요건을 충족하면서 캐나다에 계속 머무는 동안 기존 조건에 따라 일할 수 있다고 설명합니다.
여기에서 핵심 단어가 있습니다.
“캐나다에 계속 머무는 동안”입니다.
Maintained status 중 한국에 다녀오면 어떻게 되나요?
이 부분은 특히 조심해야 합니다.
IRCC의 현재 Work Permit 여행 안내는 연장신청이 아직 처리 중일 때 캐나다를 떠났다가 돌아오는 경우를 별도로 설명합니다.
해외에 있는 동안 새 Work Permit이 승인됐다면
캐나다에 Worker로 재입국하도록 허용될 수 있고, 입국 후 일을 시작할 수 있습니다.
귀국할 때도 연장신청이 아직 심사 중이라면
Visitor로 재입국을 허용받을 수 있지만, 새 Work Permit이 승인될 때까지 일을 하지 못할 수 있습니다.
즉,
“캐나다에 다시 들어왔다”와 “다시 출근할 수 있다”는 같은 뜻이 아닙니다.
이건 실제 근로자에게 상당히 큰 차이입니다.
사례로 보면 더 쉽습니다
A씨는 캐나다 회사에서 근무하고 있습니다.
기존 Work Permit은 9월 15일 만료됩니다.
A씨는 8월 20일에 Work Permit 연장신청을 정상적으로 제출했습니다.
9월 15일 이후에도 신청이 처리 중이라면 일정한 조건에서 maintained status로 기존 직장에서 일을 계속할 수 있습니다.
그런데 A씨가 9월 25일 한국에 갑니다.
10월 5일 캐나다로 돌아올 예정인데 그때까지 새 Permit이 승인되지 않았습니다.
A씨가 유효한 TRV를 가지고 있어 캐나다 입국을 허용받았다고 하더라도, 그것만으로 10월 6일부터 바로 출근해도 된다는 뜻은 아닙니다.
귀국 시점의 Work Permit 신청상태와 근무권한을 별도로 확인해야 합니다.
Employer-specific Work Permit이라면 또 하나를 확인해야 합니다
Employer-specific Work Permit에는 보통 특정 고용주나 다른 근무조건이 붙어 있습니다.
예를 들어 A회사 Permit을 가지고 있으면서 B회사로 옮기기 위한 새 Work Permit을 신청했다고 해보겠습니다.
기존 Permit이 만료된 뒤 maintained status가 생겼다고 해서 자동으로 B회사에서 일을 시작할 수 있는 것은 아닙니다.
IRCC는 Work Permit 연장·조건변경 신청 중에는 기존 Permit 조건이 중요한 경우가 있음을 안내합니다.
따라서 해외여행과 동시에 고용주 변경까지 진행 중이라면 다음을 분리해서 봐야 합니다.
- 캐나다에 재입국할 수 있는가
- 캐나다에 어떤 신분으로 입국하는가
- 귀국 후 일을 할 수 있는가
- 일을 할 수 있다면 어느 고용주를 위해 일할 수 있는가
“TRV가 만료됐는데 미국만 잠깐 갔다 오면 괜찮다”는 이야기는요?
이런 이야기를 인터넷에서 접하는 경우가 있습니다.
캐나다 이민규정에는 미국 또는 Saint-Pierre and Miquelon과 관련된 일부 예외적인 재입국 규정이 존재할 수 있습니다.
그러나 이를 **“TRV가 만료되면 미국을 들렀다 오면 무조건 된다”**고 일반화해서는 안 됩니다.
현재 신분, 여행지역, Permit 유효 여부, 출국기간과 신청상태에 따라 결과가 달라질 수 있습니다.
특히 일반적인 한국 방문이나 다른 해외여행에 그대로 적용할 규칙은 아닙니다.
따라서 여행경로를 이용해 규정을 우회하려 하기보다 본인의 정확한 여행서류와 신분을 기준으로 판단하는 것이 안전합니다.
Work Permit만 확인하고 비행기표를 끊으면 안 되는 이유
해외여행 전에는 적어도 다음 네 영역을 함께 확인해야 합니다.
1. Passport
여권의 유효기간이 충분한지 확인합니다.
Work Permit의 유효기간도 여권 만료일의 영향을 받을 수 있습니다.
2. Work Permit 또는 Study Permit
현재 실제 Permit의 만료일을 봅니다.
연장신청 중이라면 maintained status인지 확인합니다.
3. TRV 또는 eTA
국적과 여행방법에 따라 캐나다 귀국에 필요한 여행문서가 무엇인지 확인합니다.
Work Permit 자체는 여행문서가 아닙니다. IRCC도 이 점을 명확히 안내합니다.
4. Pending application
연장신청 또는 고용주 변경 신청이 진행 중이라면 출국이 그 근무권한에 어떤 영향을 줄지 확인해야 합니다.
출국 전 실제 체크리스트
다음 질문에 모두 답할 수 있으면 상황이 훨씬 명확해집니다.
- 현재 Work Permit 또는 Study Permit은 언제 만료되는가?
- Permit 자체가 아직 유효한가, 아니면 maintained status인가?
- 현재 TRV는 언제 만료되는가?
- eTA 대상인지 TRV 대상인지?
- 여권은 언제 만료되는가?
- 출국일은 언제인가?
- 캐나다 귀국일은 언제인가?

가족은 각자 문서를 확인해야 합니다
주신청자의 Work Permit이 유효하다고 해서 배우자와 자녀의 모든 문서까지 자동으로 해결되는 것은 아닙니다.
예를 들어 근로자의 배우자는 별도 Work Permit을 가지고 있을 수 있고, 자녀는 Visitor Record 또는 Study Permit을 가지고 있을 수 있습니다.
해외여행 전에는 가족 구성원별로 각각 다음을 확인해야 합니다.
- Passport

- 신청 중인 extension
한 가족이라고 해서 여행문서가 하나로 묶이는 것은 아닙니다.
흔한 오해 1 — “Work Permit이 2년 남았으니 여행도 2년 동안 자유롭다”
그렇지 않습니다.
Work Permit의 유효기간과 TRV의 유효기간은 다를 수 있습니다.

Can You Return to Canada with a Valid Work Permit but an Expired TRV?
Imagine that you are working legally in Canada under a work permit that remains valid for another year.
You plan a short trip abroad and assume there should be no problem returning because your work permit is still valid.
Then you check your passport and realize that the Temporary Resident Visa, or TRV, has expired.
Can you still travel and return to Canada?
A valid work permit and a valid document for travelling back to Canada are not the same thing.
A work permit authorizes employment in Canada under specified conditions. A TRV is a travel document used by visa-required foreign nationals to travel to Canada and seek entry.
IRCC specifically states that extending a work permit or study permit does not automatically issue a new visitor visa. A separate TRV application may be required.
Why doesn't a valid work permit replace a TRV?
Canadian immigration documents perform different functions.
There are at least three separate concepts to understand.
Temporary status in Canada
A work permit, study permit or visitor record may be relevant to the person's authorized stay in Canada.
Authorization to work or study
A work permit controls the circumstances under which a foreign national may work.
A study permit controls the circumstances under which a foreign national may study.
The document used to travel back to Canada
Visa-required foreign nationals generally need a valid TRV to travel to Canada.
Visa-exempt foreign nationals may require an eTA depending on their citizenship and method of travel.
Possessing one type of document does not automatically establish the others.
Does a work permit extension automatically renew the TRV?
No.
A worker may receive a new work permit valid well into the future while the TRV in the passport has already expired.
IRCC expressly provides a separate process for eligible workers and students in Canada who need a new visitor visa.
This means that:
- extending a work permit
- extending a study permit
- renewing a TRV
are separate immigration processes.
Can a worker or student apply for a new TRV from inside Canada?
In qualifying circumstances, yes.
IRCC currently provides an in-Canada process for workers and students who hold valid work or study permits and need a new visitor visa for future travel.
Relevant conditions include being physically in Canada, having a valid work or study permit, planning to leave and return to Canada in the near future, and having a visitor visa that has expired or is about to expire.
The application is generally submitted online through the IRCC secure account.
One point that can confuse applicants is the form name.
The checklist may provide IMM 5257, titled “Application for Visitor Visa (Temporary Resident Visa) Made Outside of Canada,” even though the applicant is physically in Canada.
IRCC currently instructs eligible in-Canada workers and students to use that form through the designated online process.
What if you have already left Canada?
The analysis changes.
IRCC's current in-Canada TRV guidance instructs people who have already left Canada to follow the applicable outside-Canada visitor visa process.
This is one reason to review travel documents before departure rather than assuming that the visa issue can easily be fixed after arrival abroad.
A delayed TRV can affect more than a vacation.
It may affect a scheduled return to work, a school term, housing arrangements and family travel.
Does a valid TRV guarantee entry?
No.
A TRV permits a visa-required traveller to travel to Canada and request entry.
It does not guarantee admission.
IRCC's current work-permit travel guidance explains that a valid visa or eTA does not guarantee re-entry. The traveller must still satisfy the border services officer that all entry requirements are met.
A valid permit is different from maintained status
This distinction becomes especially important when a work permit extension is pending.
A worker whose physical work permit remains valid is in a different situation from a worker whose permit has expired after a timely extension application and who is relying on maintained status.
IRCC states that a worker who submits an eligible extension or change-of-conditions application before the existing permit expires may continue working under the original conditions while the application is pending, provided the worker stays in Canada.
The words “as long as you stay in Canada” matter.
What happens if you travel while relying on maintained status?
IRCC now provides specific guidance for this situation.
If the work permit extension is approved while the worker is abroad, the person may be allowed to re-enter Canada as a worker and work after entry.
However, if the extension application is still being processed when the worker returns, the person may be allowed to re-enter as a visitor and cannot work until the work permit renewal has been approved.
This creates an important practical distinction:
Being allowed back into Canada does not necessarily mean being allowed to resume employment immediately.
Example
Assume that a worker's current work permit expires on September 15.
The worker files a proper extension application on August 20.
After September 15, the application remains pending and the worker continues working in Canada under maintained status.
The worker then leaves Canada on September 25 and returns on October 5.
If the extension is still pending on October 5, the fact that the worker applied before the old permit expired does not automatically mean that work may resume on October 6.
The person's status on re-entry and current work authorization must be reviewed separately.
What if the worker is changing employers?
Employer-specific work permits add another layer.
Suppose the current permit authorizes work for Employer A, while an application has been filed for a new permit with Employer B.
Maintained status does not automatically allow the worker to begin working for Employer B simply because the new application has been submitted.
IRCC's current extension guidance emphasizes that maintained authorization generally follows the conditions of the existing work permit while the new application is pending, subject to any separate authorization that may apply.
When international travel and an employer change happen at the same time, at least four questions should be separated:
- Can the person seek re-entry to Canada?
- In what status may the person be admitted?
- Can the person work after return?
- If work is authorized, for which employer?
A work permit is not a travel document
IRCC states this directly in its current travel guidance.
A work permit does not itself authorize travel to or re-entry into Canada. Depending on citizenship, nationality and method of travel, the person may require a TRV or eTA.
Before booking travel, therefore, review:
- passport validity
- current work or study permit validity
- TRV or eTA validity
- any pending extension application
- departure and return dates
- whether immediate return to work is necessary
- whether an employer change is pending
- the documents of accompanying family members
Family members need their own review
A principal worker's valid permit does not automatically resolve the travel-document requirements of a spouse or child.
A spouse may hold a separate work permit.
A child may hold a study permit or visitor status.
Each family member's passport, TRV or eTA, permit and any pending application should be checked separately.
Common misunderstanding: “My work permit is valid for two years, so I can travel freely for two years.”
Not necessarily.
The work permit and the TRV may have different expiry dates.
Common misunderstanding: “I have a valid visa, so Canada must let me in.”
No.
A visa or eTA does not guarantee admission.
Common misunderstanding: “I filed my extension before expiry, so I can travel and keep working.”
Not automatically.
Travel can affect the work authorization associated with maintained status.
A practical Yujin Visa review
For this type of case, it is useful to create one chronological timeline:
current permit issuance → permit expiry → extension filing → TRV expiry → departure date → planned return → required return-to-work date
Once these dates are placed together, the real risk is often much easier to identify.
This is particularly important where the work permit is close to expiry, maintained status is involved, or an employer change is pending.
The most important travel question is not simply whether you can board the flight. It is what status and work authorization you will actually have on the day you return to Canada.
