1. 해고되었다고 체류기간 자체가 즉시 끝나는 것은 아닙니다
Employer-specific work permit에는 특정 고용주, 직무 또는 근무조건이 연결되어 있습니다. 따라서 그 고용관계가 종료되면 기존 permit이 허용한 고용주를 위한 실제 근무는 더 이상 이어갈 수 없지만, permit에 적힌 체류 유효기간이 해고 당일 자동으로 삭제되는 것은 아닙니다.
중요한 것은 체류할 수 있는 기간과 누구를 위해 일할 수 있는 권한을 같은 것으로 보지 않는 것입니다. 새 고용주가 생겼다면 새 고용조건에 맞는 permit 절차를 확인해야 합니다.
IRCC의 현재 안내는 해고된 employer-specific work permit 소지자가 캐나다에서 계속 일하려면 새 job offer를 받고, 캐나다 안에서 새 work permit을 신청해야 한다고 설명합니다. 새 고용주를 구하지 못한다면 permit에 표시된 “must leave by” 날짜도 확인해야 합니다.
2. 새 오퍼를 받아도 바로 출근하면 안 되는 이유
Open work permit과 달리 employer-specific work permit은 고용주가 제한되어 있습니다. 그래서 새 회사의 offer letter, LMIA 또는 LMIA-exempt offer가 준비됐다는 사실만으로 기존 permit의 고용주 조건이 자동 변경되지는 않습니다.

3. PPCHANGEWORK2020은 무엇인가요?

4. Maintained status가 있으면 새 회사에서도 자동으로 일할 수 있나요?

기존 work permit이 만료되기 전에 연장 또는 조건변경 신청을 적법하게 제출한 경우, 일정한 상황에서는 캐나다에 머무르면서 종전 permit 조건으로 계속 일할 수 있습니다. 그러나 고용주 변경 신청 중 기존 permit이 만료됐다는 이유만으로 새 고용주를 위한 근무권한이 자동 생기는 것은 아닙니다.
IRCC는 employer-specific permit 조건을 바꾸는 신청이 pending인 동안 maintained status가 있다면, 원칙적으로 기존 permit에 적힌 원래 고용주 조건을 따라야 한다고 안내합니다. 새 고용주에게 먼저 일하려면 별도의 authorization을 요청하고 실제로 받아야 합니다.

6. 기존 permit이 이미 만료된 경우는 별도로 봐야 합니다
해고 사실만으로 restoration이 필요한 것은 아닙니다. 반대로 work permit 유효기간이 이미 끝났고 적절한 연장·변경 신청도 하지 않았다면, 단순한 “고용주 변경” 문제를 넘어 status restoration 여부를 확인해야 할 수 있습니다.
특히 “90일 안이면 무조건 일할 수 있다”는 식으로 이해하면 안 됩니다. Restoration 신청 가능기간과 실제 근무권한은 별개의 문제입니다. 일을 계속할 수 있는지 여부는 permit 만료 전 신청 여부, 신청 종류, 현재 캐나다 내 status를 함께 확인해야 합니다.

7. IRCC의 temporary public policy도 현재 유효합니다
IRCC의 “changing employment” temporary public policy는 고용주나 직무를 바꾸는 캐나다 내 외국인 근로자가 새 work permit의 최종 결정을 기다리는 동안 더 빨리 새 일을 시작할 수 있도록 마련됐습니다. 이 정책은 2025년 3월 4일 서명되었고 12주 뒤 효력이 발생했으며, 현재 공식 페이지는 Minister가 철회할 때까지 유효하다고 명시합니다.

I Was Laid Off on an Employer-Specific Work Permit. Can I Start With a New Employer Right Away?
If you are working in Canada on an employer-specific work permit and you are laid off or your employment ends, the immediate concern is usually whether you can begin working for a new company as soon as you receive a new offer.
Short answer: a new job offer does not, by itself, authorize you to work for the new employer. IRCC generally requires a person who holds an employer-specific work permit and changes employers or jobs to apply for a new work permit. However, if you are in Canada, meet the applicable conditions, and submit a new employer-specific work permit application, you may be able to request separate authorization to work while the new application is being processed.
1. A layoff does not automatically erase the printed validity date of your permit
An employer-specific work permit is tied to conditions such as a named employer, occupation or location. Once that employment ends, you cannot simply treat the permit as authorization to work for any other employer. At the same time, the distinction between your temporary resident status and your authority to work for a specific employer remains important.
IRCC states that a worker who loses the job connected to an employer-specific work permit and wants to continue working in Canada must obtain a new job offer and apply for a new work permit. If a new job offer cannot be obtained, the worker must also pay attention to the “must leave by” date on the permit.
2. Why a new offer does not mean you can immediately start work
Unlike an open work permit, an employer-specific permit does not automatically move with you to a new employer. A new offer letter, LMIA or LMIA-exempt offer therefore does not by itself change the conditions printed on the existing permit.
A practical sequence is usually to:
- determine whether the new position requires an LMIA or qualifies for an LMIA exemption;
- make sure the new employer has completed the required employer-side steps;
- submit the new employer-specific work permit application from inside Canada, if eligible;
- request IRCC authorization to start the new job while the application is pending; and
- wait until IRCC actually grants that authorization before beginning work for the new employer.
3. What is the PPCHANGEWORK2020 process?
IRCC’s current instructions allow certain workers who have already applied for a new employer-specific work permit to request authorization through the IRCC web form to begin working for the new employer before the final permit decision. The official instructions require the priority code PPCHANGEWORK2020 in the request.
The process is not an automatic extension of the old permit. The applicant must fit the conditions described by IRCC and must have a pending new employer-specific work permit application. IRCC then sends an email telling the applicant whether they are authorized to work while the application is being processed. IRCC currently says it should respond in about 10 to 15 days, although actual timing may vary. The authorization email is not the new work permit itself.

4. Does maintained status automatically let you work for the new employer?
No. Maintained status is frequently misunderstood in this context.
If you submitted an eligible extension or change-of-conditions application before your work permit expired, you may be permitted to remain in Canada and continue working under the conditions of the original permit while IRCC processes the application. But if the original permit named a specific employer, maintained status generally preserves those original conditions. It does not automatically authorize employment with the new company.
To begin the new job before the permit decision, you generally need to request and receive the separate work authorization described above.

5. What to check immediately after a layoff
Review the expiry date and conditions on your current permit, the new job offer, whether an LMIA or LMIA-exempt process is required, whether the new work permit application has actually been filed, and whether IRCC has granted the separate authorization to start the new job. Previous status-expiry or refusal history can also change the analysis.
6. If the old permit has already expired, the issue may be different
A layoff itself does not create a restoration requirement. But if your work permit has already expired and you did not make a qualifying application before expiry, you may need to assess restoration of status rather than treating the matter as a simple employer change.
The existence of a restoration window does not automatically give you the right to work. Filing deadlines and work authorization must be analyzed separately.

7. The temporary public policy remains relevant
IRCC’s temporary public policy on changing employment was designed to allow eligible foreign workers already in Canada to begin new employment more quickly while a new work permit application is pending. The current policy page states that it remains in effect until revoked by the Minister.
It can cover situations such as layoffs, a new role with the same employer, workplace conflict, or moving to a better opportunity. It is not automatic: the applicant must meet the policy conditions, submit the new work permit application, and make the required exemption request.
