배우자초청 PR은 접수했는데 AOR이 아직 안 왔습니다. 체류신분이 2주 안에 끝나면 OWP를 신청할 수 있나요?
캐나다 안에서 배우자 또는 common-law partner 초청 영주권 신청서를 제출한 뒤 Open Work Permit(OWP)을 준비하는 분들이 자주 부딪히는 문제가 있습니다. 영주권 신청은 온라인으로 제출했는데, IRCC의 Acknowledgement of Receipt(AOR)가 아직 도착하지 않았고 기존 Work Permit, Study Permit 또는 방문자 신분의 만료일은 빠르게 다가오는 상황입니다.
일반적인 원칙은 배우자초청 PR 신청의 AOR을 받은 뒤 OWP를 신청하는 것입니다. 하지만 IRCC는 현재 매우 구체적인 예외를 두고 있습니다. 현재 Work Permit, Study Permit 또는 temporary resident status가 2주 이내에 만료되고, 이미 배우자·파트너 초청 영주권 신청을 제출한 경우에는 일정 요건 아래 AOR 없이 OWP를 신청할 수 있습니다.
이 예외는 “AOR이 늦으면 누구나 먼저 OWP를 낼 수 있다”는 의미가 아닙니다. 만료일까지 남은 기간과 PR 신청 클래스, 현재 체류신분, 제출 증빙을 정확히 맞춰야 합니다.

원칙적으로는 AOR을 받은 뒤 신청합니다
IRCC의 현재 지침에 따르면 배우자·파트너 초청을 통해 캐나다 안에서 OWP를 신청하려는 주신청인은 일반적으로 다음을 충족해야 합니다.
- 스폰서와 genuine relationship에 있어야 합니다.
- 영주권 신청에 포함되어 있어야 합니다.
- 해당 영주권 신청이 처리 중이라는 AOR이 있어야 합니다.
- 캐나다에서 스폰서와 함께 거주해야 합니다.
IRCC가 말하는 AOR은 단순한 “온라인 제출 완료 화면”과 같지 않습니다. 공식 지침은 AOR을 IRCC가 신청 패키지를 검토하고 complete하다고 확인한 뒤 발급되는 접수확인으로 설명하며, application number가 포함됩니다.
따라서 단순 결제영수증이나 제출확인 메일을 평소의 AOR과 동일하게 취급하면 안 됩니다.
AOR 없이 신청할 수 있는 ‘2주 예외’
IRCC는 AOR을 아직 받지 못한 신청인을 위해 제한적인 예외를 안내하고 있습니다.
AOR 없이 OWP를 신청하려면 다음 두 조건을 모두 충족해야 합니다.
- 현재 Work Permit, Study Permit 또는 temporary resident status가 2주 이내에 만료될 예정이고,
- 이미 다음 중 하나로 영주권 신청을 제출했어야 합니다.
- Spouse or Common-Law Partner in Canada Class(SCLPC)의 spouse 또는 common-law partner
- Family Class의 spouse, common-law partner 또는 conjugal partner
이 요건은 매우 좁습니다. 예를 들어 신분 만료가 두 달 남았는데 단지 AOR이 아직 오지 않았다는 이유만으로 이 예외를 사용할 수 있는 것은 아닙니다.
어떤 증빙을 올려야 하나요?
IRCC는 AOR이 없는 상태에서 이 예외를 사용하는 경우 Client Information 등에 일반적인 AOR 대신 특정 자료를 제출하도록 안내합니다.
핵심 자료는 다음과 같습니다.
- 현재 Work Permit, Study Permit 또는 Visitor Record 등 현재 신분을 보여주는 문서 사본
- 영주권 신청을 실제로 제출했다는 증빙
- 예: IRCC가 보낸 PR application submission confirmation 이메일 등
- 혼인관계 또는 common-law 관계를 입증하는 해당 서류
- dependent child가 있다면 필요한 가족관계 자료
- 현재 적용되는 document checklist의 기타 서류
여기서 중요한 것은 PR 초안을 만들어 둔 것이나 포털에 계정을 생성한 것은 제출 증빙이 아니라는 점입니다. 영주권 신청이 실제로 제출된 상태여야 합니다.
만료일 계산을 정확히 해야 합니다
“2주”는 편의상 느슨하게 해석할 표현이 아닙니다. 신청 준비를 시작한 날이 아니라 실제 OWP를 제출하는 시점에서 현재 permit 또는 temporary resident status의 만료일까지 남은 기간을 확인해야 합니다.
또한 다음을 혼동하지 않아야 합니다.
- 여권의 만료일
- TRV 스티커의 만료일
- eTA의 유효기간
- Work Permit 또는 Study Permit의 만료일
- Visitor Record의 만료일
- 입국 시 별도 기록이 없는 방문자의 authorized stay 종료일
배우자초청 OWP의 2주 예외에서는 현재 캐나다 내 temporary resident status가 핵심입니다. TRV나 eTA는 캐나다에 입국하기 위한 travel document와 관련된 문제이므로 체류신분 만료일과 동일하게 보지 않습니다.
현재 신분이 이미 만료됐다면 같은 규칙을 적용하면 안 됩니다
이 글에서 가장 중요한 구분입니다.
IRCC의 AOR 없는 2주 예외는 현재 신분이 곧 만료되는 사람을 위한 규칙입니다. 이미 체류신분을 잃은 사람에게 그대로 적용되는 일반적인 구제규정이 아닙니다.
IRCC는 valid temporary resident status의 범주에 유효한 permit 또는 visitor record뿐 아니라 maintained status, 그리고 일정한 restoration 요건을 충족한 경우를 포함해 설명하고 있습니다. 그러나 실제로 out of status인 배우자초청 신청인에게는 별도의 규칙이 적용될 수 있습니다.
현재 IRCC 안내에 따르면 spousal public policy 아래 PR 신청이 처리 중이지만 valid temporary resident status가 없는 경우, 일반적으로 **approval in principle(AIP)**을 받을 때까지 기다린 뒤 OWP 자격을 검토해야 하며, AIP 후 out-of-status 상태에서 신청하는 경우 paper application 절차가 안내됩니다.
따라서 “신분이 이미 끝났는데 PR을 냈으니 2주 예외로 OWP를 내면 된다”는 접근은 위험합니다.
OWP를 신청했다고 바로 일을 시작할 수 있는 것은 아닙니다
배우자초청 OWP 신청과 실제 근무권한은 별개의 문제입니다.
현재 Visitor Record를 가진 방문자가 OWP를 제출했다고 해서 승인 전부터 자동으로 일할 수 있는 것은 아닙니다. 기존에 Work Permit으로 합법적으로 일하고 있던 사람이 permit 만료 전에 적절한 연장·조건변경 신청을 제출한 경우에는 maintained status 아래 근무권한을 별도로 검토할 수 있지만, visitor가 OWP를 신청하는 상황과 같은 방식으로 단정해서는 안 됩니다.
따라서 입사일이 예정되어 있다면 현재 어떤 status와 work authorization을 가지고 있는지를 별도로 확인해야 합니다.
Port of Entry에서 신청하는 방법은 사용할 수 없습니다
IRCC는 이 배우자초청 OWP public policy 아래에서는 Port of Entry에서 OWP를 신청할 수 없다고 명시하고 있습니다.
또한 해당 영주권 신청이 이미 refused, withdrawn 또는 returned 상태라면 이 public policy로 OWP를 신청할 수 없습니다.
신청 전 PR application status도 반드시 확인해야 합니다.
AOR이 나오면 어떤 점이 달라지나요?
AOR을 받았다면 원칙적인 절차로 OWP 신청이 가능합니다. IRCC의 현재 안내는 valid temporary resident status를 가진 신청인이 AOR을 받은 뒤 IRCC secure account를 통해 온라인으로 OWP를 신청하도록 안내하고 있습니다.
또한 현재 public policy 아래에서 발급받은 OWP의 연장이 필요한 경우에는 AOR을 받았고, PR 신청이 여전히 처리 중이며, 스폰서와 캐나다에서 함께 거주하는 등 추가 요건을 확인해야 합니다.
즉, 최초 신청과 연장 신청은 같은 요건이라고 가정하지 말아야 합니다.
흔한 실수
첫째, “PR을 온라인으로 제출했다”는 사실만으로 즉시 OWP를 낼 수 있다고 생각하는 것입니다. 보통은 AOR을 기다려야 하며, AOR 없는 신청은 2주 예외 요건을 충족해야 합니다.
둘째, TRV 또는 eTA 만료일을 temporary resident status 만료일로 착각하는 것입니다.
셋째, 현재 신분이 이미 만료된 상태인데도 2주 예외를 적용하려는 것입니다. out-of-status 신청은 별도의 spousal public policy와 AIP 규칙을 확인해야 합니다.
넷째, OWP 신청 자체가 즉시 work authorization을 만든다고 생각하는 것입니다. 현재 status와 기존 permit 종류에 따라 근무 가능 여부는 별도로 검토해야 합니다.
신청 전 체크리스트
- PR 신청이 실제로 제출되었는지 확인합니다.
- 신청 클래스가 SCLPC 또는 해당 Family Class 배우자·파트너 초청인지 확인합니다.
- 현재 Work Permit, Study Permit 또는 visitor status 만료일을 확인합니다.
- OWP 제출 시점에 만료까지 2주 이하인지 계산합니다.
- AOR이 이미 발급되지 않았는지 다시 확인합니다.
- AOR이 없다면 현재 status 문서와 PR 제출증빙을 준비합니다.
- PR 신청이 returned, withdrawn 또는 refused 상태가 아닌지 확인합니다.
- 현재 일을 하고 있다면 maintained status와 work authorization을 별도로 확인합니다.
- 이미 out of status라면 2주 예외가 아니라 AIP 및 별도 OWP 절차를 검토합니다.

Spousal Sponsorship OWP Without an AOR: What If Your Status Expires Within Two Weeks?
Sponsored spouses and partners in Canada normally apply for an open work permit after receiving an Acknowledgement of Receipt (AOR) for their permanent residence application. A practical problem arises when the PR application has been submitted but the AOR has not arrived and the applicant's current work permit, study permit or temporary resident status is about to expire.
IRCC currently provides a narrow exception that may allow an open work permit application without an AOR when the applicant's current status will expire in two weeks or less and the permanent residence application has already been submitted under an eligible spousal sponsorship class.
This is not a general rule allowing every sponsored spouse to skip the AOR requirement.

The normal rule is to wait for the AOR
For a principal permanent residence applicant to apply for this open work permit, IRCC generally requires the applicant to:
- be in a genuine relationship with the sponsor;
- be included in a permanent residence application;
- have an AOR confirming that the PR application is being processed; and
- live in Canada with the sponsor.
IRCC describes the AOR as confirmation that the application package has been reviewed for completeness. It contains an application number, typically beginning with the letter F.
A payment receipt or simple online submission screen should not automatically be treated as the same document.
The two-week exception
IRCC states that an applicant may apply for the open work permit without an AOR only if both of the following are true:
- the applicant's work permit, study permit or temporary resident status will expire in two weeks or less; and
- the applicant has already submitted a permanent residence application under either:
- the Spouse or Common-Law Partner in Canada Class as a spouse or common-law partner; or
- the Family Class as a spouse, common-law partner or conjugal partner.
The exception is intentionally narrow. An applicant whose status remains valid for several more months cannot use the exception merely because the AOR has not arrived yet.
What should be submitted instead of the AOR?
IRCC instructs applicants using the exception to provide evidence such as:
- a copy of the current work permit, study permit or visitor record; and
- proof that the permanent residence application was actually submitted, such as IRCC's successful-submission confirmation email.
The personalized checklist may also require family information forms, a marriage certificate or common-law declaration, and children's birth certificates where applicable.
Creating a PR Portal account or saving a draft application is not the same as submitting a PR application.
Calculate the expiry date carefully
The two-week test should be based on the expiry of the applicant's current temporary resident status, not on unrelated travel-document dates.
Do not confuse:
- passport validity;
- TRV validity;
- eTA validity;
- work-permit or study-permit expiry;
- visitor-record expiry; or
- the end of an authorized visitor stay where no visitor record was issued.
A TRV or eTA is primarily an entry document. It does not, by itself, determine how long a person is authorized to remain in Canada.
If you are already out of status, do not rely on the two-week exception
This is a critical distinction.
The no-AOR exception is designed for a person whose current temporary status is about to expire. It is not a general remedy for someone who has already lost status.
IRCC's current instructions explain that a sponsored spouse or partner without valid temporary resident status may need to rely on the spousal public policy and generally wait until receiving approval in principle before becoming eligible to apply for an open work permit. An out-of-status applicant applying after approval in principle may need to use a paper application and provide an explanation.
Do not assume that filing the PR application automatically restores status or creates work authorization.
Filing the OWP does not automatically authorize work
An open work permit application and the legal authority to work are separate questions.
A visitor who submits an OWP application does not automatically gain the right to start working while the application is pending.
A worker who files an eligible application before the current work permit expires may have maintained-status rights in certain circumstances, but those rules must be assessed separately based on the person's current permit and the application filed.
If employment is scheduled to begin soon, confirm the applicant's actual work authorization rather than relying on the fact that an OWP application has been submitted.
You cannot use this policy at the port of entry
IRCC states that this open work permit cannot be applied for at a port of entry under the spousal public policy.
The policy is also unavailable if the underlying permanent residence application has already been refused, withdrawn or returned.
Check the PR application status before filing the OWP.
What changes after the AOR arrives?
Once the AOR has been issued, an applicant with valid temporary resident status can generally use the standard online process in the IRCC secure account, assuming the other eligibility requirements are met.
Different requirements may apply if the applicant later needs to extend an OWP issued under this public policy, so an extension should not be treated as identical to the initial application.
Common mistakes
A common mistake is assuming that submitting a spousal PR application automatically makes the applicant eligible to file the OWP immediately. Normally, the AOR is required.
Another error is using the TRV or eTA expiry date as the temporary-status expiry date.
Applicants also sometimes try to use the two-week exception after status has already been lost. Out-of-status cases require a different analysis.
Finally, submitting an OWP application does not by itself create immediate work authorization.
Practical checklist
Before using the no-AOR exception:
- confirm the PR application has actually been submitted;
- confirm the class of sponsorship is eligible;
- identify the correct expiry date for current temporary resident status;
- calculate whether two weeks or less remain on the date of OWP filing;
- confirm that no AOR has already been issued;
- prepare current-status evidence and PR-submission proof;
- confirm the PR application has not been returned, withdrawn or refused;
- separately assess maintained status and work authorization if currently employed; and
- if already out of status, review the approval-in-principle rules instead of relying on the two-week exception.
