최근 유진비자에 비슷한 상담이 있었습니다.
한 가족은 부모 중 한 명이 Study Permit을, 다른 한 명이 Open Work Permit을 보유하고 있었고, 두 미성년 자녀는 Visitor Record 상태로 캐나다 학교에 다니고 있었습니다.
부모의 퍼밋 만료를 앞두고 한 부모는 한국으로 귀국하고, 다른 부모와 자녀들은 캐나다에 약 1년 더 체류할 계획이었습니다. 자녀들은 기존 공립학교에서 사립학교로 전학할 예정이었고, 이 과정에서 다음과 같은 질문이 생겼습니다.

이 문제는 단순히 학교에서 입학허가서를 받았는지만 보면 안 됩니다.
현재 자녀가 왜 Study Permit 없이 공부할 수 있는지, 그 근거가 언제까지 유지되는지를 먼저 확인해야 합니다.

경우에 따라 가능합니다.
캐나다 이민난민시민부(IRCC)는 이미 캐나다에 있는 미성년 자녀가 초등학교 또는 중·고등학교에 다니면서 부모가 캐나다에서 일하거나 공부할 권한을 가지고 있는 경우, 별도의 Study Permit 없이 공부할 수 있는 경우가 있다고 안내하고 있습니다.
따라서 부모가 유효한 Study Permit 또는 Work Permit을 가지고 있고 자녀도 캐나다에서 유효한 체류신분을 유지하고 있다면, 자녀가 Visitor Record만 가지고 학교에 다니는 상황이 발생할 수 있습니다.

부모의 Work Permit이 만료되고 Visitor가 되면 상황이 달라지나요?
네. 이 부분이 가장 중요합니다.
IRCC의 미성년 자녀 안내는 캐나다에 이미 있는 자녀의 경우에도 부모가 Study Permit 또는 Work Permit을 가지고 있는 경우와, 부모가 Visitor이고 Work Permit 또는 Study Permit을 가지고 있지 않은 경우를 구분하고 있습니다.
부모가 Visitor 신분만 가지고 있고 별도의 Study Permit이나 Work Permit이 없다면, 자녀가 초·중등학교에 계속 다니기 위해 Study Permit이 필요한 상황이 될 수 있습니다.
따라서 현재 자녀가 Study Permit 없이 학교에 다닐 수 있다고 해서 앞으로도 자동으로 같은 조건이 유지된다고 생각해서는 안 됩니다.

여기서 특히 주의해야 합니다.
기존 Study Permit을 가지고 있던 학생이 만료 전에 연장을 신청한 경우와, 지금까지 Study Permit 없이 공부하던 미성년 자녀가 처음으로 Study Permit을 신청하는 경우는 동일하게 볼 수 없습니다.
부모의 Work Permit 또는 Study Permit이 유효한 동안에는 자녀가 별도의 Study Permit 없이 공부할 수 있는 예외가 적용될 수 있습니다.
그러나 그 부모의 학업·근무 권한이 끝나고 Visitor 신분만 남게 되면, 기존에 적용되던 자녀의 학업 예외도 다시 검토해야 합니다.

캐나다 안에서 미성년 자녀의 신규 Study Permit을 신청할 수 있나요?
캐나다 안에서 모든 사람이 자유롭게 최초 Study Permit을 신청할 수 있는 것은 아닙니다.
다만 이 사례처럼 이미 캐나다에서 초·중등학교에 다니고 있는 미성년 자녀라면 캐나다 내 신청이 가능한 경우가 있습니다.
캐나다 이민규정(IRPR) section 215는 캐나다에 입국한 뒤 Study Permit을 신청할 수 있는 여러 예외를 두고 있으며, 여기에는 캐나다에서 preschool, primary 또는 secondary level에서 공부하고 있는 Temporary Resident 등이 포함됩니다.
따라서 “기존 Study Permit이 없으니 반드시 한국으로 나가서 신청해야 한다”고 단정해서도 안 됩니다.
다만 실제 신청 경로는 자녀의 현재 신분, 부모의 신분, 학교 과정, 신청 시점에 따라 달라질 수 있으므로 제출 전 확인이 필요합니다.

사립학교로 전학하면 Study Permit 규정도 달라지나요?
학교가 공립인지 사립인지 자체만으로 미성년자의 Study Permit 필요 여부가 결정되는 것은 아닙니다.
핵심은 자녀가 캐나다에서 어떤 신분으로 공부할 권한을 가지고 있는지입니다.
그러나 이민법상 학교를 다닐 수 있다는 문제와, 해당 사립학교가 실제로 학생의 등록 및 등교를 허용하는 문제는 별개입니다.
일부 사립학교는 International Student 등록 과정에서 Study Permit 사본을 요구할 수 있고, 학교 내부정책에 따라 Study Permit이 승인된 이후에만 등교를 허용할 수도 있습니다.
따라서 학비나 큰 금액의 deposit을 납부하기 전에는 최소한 다음을 학교에 서면으로 확인하는 것이 좋습니다.

미성년 자녀의 Study Permit 신청에도 LOA가 필요한가요?
캐나다 안에서 미성년 자녀의 Study Permit을 신청하는 경우에는 학교에서 발급한 **입학허가서(Letter of Acceptance, LOA)**를 준비해야 하는 경우가 일반적입니다.
특히 이미 캐나다에 있으면서 가족 구성원의 Study Permit 또는 Work Permit을 기반으로 체류·학업해 온 자녀가 새로운 Study Permit을 신청한다면, 앞으로 실제로 다닐 학교의 입학자료가 중요합니다.
따라서 전학 예정이라면 먼저 학교의 International Student 입학절차를 확인하고, 실제 Study Permit 신청에 사용할 수 있는 LOA를 확보하는 순서가 필요합니다.
Grade 1이나 Grade 7 학생도 PAL/TAL을 받아야 하나요?
현재 기준으로 초·중등학교, 즉 kindergarten부터 Grade 12까지의 학생은 PAL/TAL 제출 면제 대상입니다.
따라서 일반적인 대학·컬리지 Study Permit 신청과 똑같이 PAL 또는 TAL을 받아야 한다고 생각할 필요는 없습니다.
다만 면제 대상이라는 사실과 함께 신청인의 실제 학교 수준과 상황이 그 예외에 해당한다는 점이 명확해야 합니다.

부모의 Work Permit이 끝난 뒤 캐나다에 남으려면 어떻게 해야 하나요?
부모가 Work Permit 연장 자격이 없지만 자녀를 돌보기 위해 캐나다에 더 체류해야 한다면 Visitor Record를 통해 Worker에서 Visitor로 신분을 변경하는 방법을 검토할 수 있습니다.
중요한 것은 현재 신분이 만료되기 전에 신청하는 것입니다.
Work Permit이 유효한 동안 Visitor Record를 신청했다면, 신청에 대한 결정이 내려질 때까지 캐나다에 체류할 수 있는 maintained status가 적용될 수 있습니다.
다만 Visitor로 변경하는 신청을 한 경우 기존 Work Permit이 만료된 이후에는 일을 계속할 수 없습니다.

Study Permit 신청 직전에 큰 금액이 입금되면 문제가 되나요?
큰 금액이 입금됐다는 사실만으로 문제가 되는 것은 아닙니다.
중요한 것은 그 돈이 어디에서 나온 것인지, 신청인이 실제로 사용할 수 있는 돈인지 설명할 수 있는가입니다.
이번 상담사례에서도 가족 재산에서 발생한 자금과 친족이 자녀 교육을 위해 지원하려는 자금이 동시에 들어올 예정이었습니다.
이 경우 단순히 은행 잔액만 보여주는 것보다 자금의 발생 → 이동 → 현재 보유 → 학비·생활비 사용 가능성이 연결되도록 자료를 준비하는 것이 좋습니다.

Does a Minor Child Need a Study Permit After a Parent’s Work Permit Expires in Canada?
Many families in Canada have minor children attending elementary or secondary school while one parent studies or works in Canada.
In some cases, the children do not hold their own study permits. This can be permitted when the children are already in Canada and a parent is authorized to study or work in Canada.
The situation can change, however, when the parent's study permit or work permit expires and the remaining parent stays in Canada only as a visitor.
A recent Yujin Visa consultation involved a family in a similar situation.
One parent held a study permit, the other held an open work permit, and two minor children were attending school in Canada while holding visitor records. As the parents' permits approached expiry, one parent planned to return overseas while the other parent and children intended to remain in Canada for approximately another year.
The children were also planning to transfer from a public school to a private school.
The key question was:
Can the children continue attending school if their new study permits have not yet been approved?
The answer depends first on why they are currently authorized to study without study permits.
Can a minor child study without a study permit when a parent has a work permit?
In certain circumstances, yes.
IRCC states that a minor child who is already in Canada and attending preschool, primary or secondary school may be able to study without a study permit when the child has a parent who is authorized to work or study in Canada.
This is why some children in Canada attend elementary or secondary school while holding only visitor status.
IRCC nevertheless recommends obtaining a study permit for minor children in many cases because holding a permit can provide greater continuity when the family's circumstances later change.

What changes when the parent's work permit expires and the parent becomes a visitor?
This is the critical issue.
IRCC distinguishes between a minor child already in Canada whose parent holds a valid work or study permit and a child whose parent is in Canada only as a visitor without a work or study permit.
When the parent's authority to work or study ends, the basis on which the child had been studying without a study permit may no longer apply.
The family's timeline therefore matters.
It is not enough to ask whether the child can currently attend school without a study permit. The family should also determine when the parent's work or study authorization ends and whether the child's new study permit will be in place by then.
Is filing a study permit application enough to allow the child to keep studying?
Families should be careful with this assumption.
A student who already holds a study permit and applies to extend it before expiry is not necessarily in the same position as a minor child who previously studied without a study permit and is now applying for an initial study permit.
While the parent's valid work or study authorization continues, the minor child may still fall within an exemption that allows school attendance without a study permit.
Once that underlying authorization ends, however, the exemption itself needs to be reassessed.
Submitting a new study permit application does not by itself create a new right to study in every situation.
The parent's own status should also be distinguished from work authorization. If a worker applies to change status to visitor before the work permit expires, the person may remain in Canada while that application is processed, but must stop working once the existing work permit expires.

Can a minor child apply for an initial study permit from inside Canada?
Not every foreign national can apply for an initial study permit from within Canada.
However, there are exceptions.
Canada's immigration regulations allow certain temporary residents already studying at the preschool, primary or secondary level to apply for a study permit after entering Canada.
As a result, a child who is already attending school in Canada should not automatically be assumed to have to leave Canada simply because the child does not currently hold a study permit.
The correct application route depends on the child's current status, family circumstances and the timing of the application.

Does transferring to a private school change the immigration rules?
The distinction between a public and private school does not by itself determine whether the child needs a study permit.
The main immigration question is whether the child is legally authorized to study in Canada.
However, immigration authorization and the private school's own enrolment policy are separate matters.
A private school may require international students to provide a study permit before they begin classes, even where immigration rules would otherwise allow a child to study temporarily without one.
Before paying substantial tuition or a non-refundable deposit, families should therefore ask the school in writing:
- whether the child may begin classes before the study permit is approved
- whether admission can be deferred if the permit is delayed
- whether tuition can be carried forward to a later term
- what refund policy applies if the permit is delayed or refused
The school's administrative requirements should be checked separately from IRCC's immigration rules.
Does a minor child need a Letter of Acceptance?
When a minor child in Canada applies for a study permit, a Letter of Acceptance (LOA) from the school will generally be an important application document.
For a child transferring to a new school, the family should therefore complete the school's international student admission process and obtain the appropriate LOA before preparing the study permit application.
Do Grade 1 or Grade 7 students need a PAL or TAL?
Under the current rules, students attending preschool, primary school or secondary school through Grade 12 are exempt from the provincial or territorial attestation letter requirement.
This means a typical elementary or secondary school applicant should not be treated in the same way as a college or undergraduate study permit applicant for PAL/TAL purposes.

What should the parent do when the work permit expires?
If the parent is not eligible to extend the work permit but needs to remain in Canada with the children, changing temporary resident status from worker to visitor through a Visitor Record application may be considered.
The application should be made before the current temporary resident status expires.
If properly filed before expiry, the parent may generally remain in Canada while IRCC processes the application.
However, if the application is to change from worker to visitor, the parent cannot continue working after the existing work permit expires.
The right to remain in Canada and the authorization to work in Canada are separate issues.

Is a large recent deposit automatically a problem for proof of funds?
No.
A large deposit is not automatically a problem. The important question is whether the source of the funds and their actual availability for the child's education and the family's living expenses can be demonstrated.
For example, where funds come from a family asset or transaction, documents should connect the underlying transaction to the deposit and subsequent transfer.
If grandparents or other family members are providing educational support, supporting evidence may include:
- a Gift Letter or Financial Support Letter
- transfer records
- evidence of the family relationship
- evidence of the financial supporter’s ability to provide the funds
- tuition payment records
- an explanation of expected tuition and living expenses
The purpose is not simply to show a high final bank balance. The financial evidence should demonstrate where the funds came from, how they moved and whether they are genuinely available for the family's planned expenses.

What should families prepare first?
When a parent's work or study permit will soon expire but the children plan to continue studying in Canada, the family should review the timeline as a whole:
- Confirm the exact expiry dates of each family member's current status.
- Identify why the children are currently permitted to study without study permits.
- Determine whether that exemption will end when the parent's work or study authorization expires.
- Confirm the new school's international student admission requirements.
- Obtain an LOA for each child.
- Ask the school whether attendance is permitted before study permit approval.
- Review deferral, tuition transfer and refund policies.
- Prepare each child's study permit application.
- Prepare the remaining parent's visitor status application where required.
- Organize tuition, living expenses and source-of-funds evidence.
IRCC processing times change regularly and depend on the application type and circumstances. Families should therefore check the current official processing time immediately before planning their filing timeline rather than relying on an older quoted number.

The child's study permit should not be reviewed in isolation
For families in this situation, the issues are connected:
parent's current immigration status → expiry of the parent's permit → possible end of the child's study-permit exemption → child's new study permit → parent's visitor status → family finances and overall temporary stay plan
An LOA or tuition payment does not itself create immigration authorization to study.
At the same time, the absence of a study permit does not necessarily mean that a minor child currently attending school in Canada must immediately stop studying.
The starting point is to determine why the child is presently authorized to study without a permit and when that authorization may end.
Individual requirements will depend on the child's current status, the parents' immigration status, the school level and the timing of the applications.
