캐나다 회사로부터 취업 제안이나 오퍼레터를 받으면, 이제 워크퍼밋도 자연스럽게 받을 수 있다고 생각하기 쉽습니다.

그런데 반드시 그렇지는 않습니다.

캐나다 회사에서 채용됐는데, 왜 워크퍼밋이 안 될 수 있을까요?

이번에 기준이 명확해진 C20은 이러한 LMIA 면제 범주 중 하나인 상호고용(Reciprocal Employment) 제도입니다.

이 제도의 핵심은 외국인 직원에게 캐나다 취업기회를 제공하는 대신, 해당 회사나 기관도 캐나다 시민권자 또는 영주권자에게 해외에서 비슷한 근무기회를 제공하거나 유지하고 있어야 한다는 것입니다.

C20 상호고용이란 무엇인가요?

C20 상호고용 워크퍼밋은 캐나다 이민난민보호규정 IRPR 205(b)에 근거합니다.

규정의 취지는 외국인이 캐나다에서 근무하는 기회를 얻는 동시에, 캐나다 시민권자나 영주권자에게도 다른 나라에서 근무할 기회가 만들어지거나 유지되도록 하는 것입니다.

반드시 캐나다와 신청인의 출신국 사이에서 정확히 한 명씩 교환해야 하는 것은 아닙니다.

예를 들어 다국적기업이 외국인 직원을 캐나다 지사에서 근무하도록 하는 동시에 캐나다 직원을 유럽, 아시아 또는 다른 지역의 해외 지사로 보내고 있다면, 회사 전체의 국제 인력교류를 근거로 상호성을 설명할 수 있습니다.

이번에 무엇이 달라졌나요?

가장 중요한 변화는 신청인이 신청 당시 해외 회사의 현재 직원이어야 한다는 점입니다.

캐나다 정부의 새로운 공식 지침에는 C20을 사용하려면 외국인이 해외 회사에 현재 고용되어 있어야 하고, 워크퍼밋 신청서를 제출하기 전에 해외 조직과의 고용주·근로자 관계가 이미 형성돼 있어야 한다고 명시되어 있습니다.

왜 신규 채용자는 제한되는 것일까요?

IRCC의 공식 지침은 캐나다 입국 후에 회사와의 고용을 처음 시작하는 사람은 해외 조직과 캐나다 조직 사이에서 지식이나 경험을 교환한다는 상호고용의 취지에 맞지 않을 수 있다고 설명합니다.

즉, 단순한 채용이 아니라 기존 국제 인력교류의 연장인지가 중요해진 것입니다.

사례 1: 해외 회사에서 이미 근무 중인 직원

김 씨는 한국에 있는 다국적기업의 지사에서 2년 동안 근무했습니다.

회사는 김 씨를 캐나다 지사로 1년간 이동시키려고 합니다.

김 씨에게는 기존 해외 근로계약서, 재직증명서, 급여명세서와 실제 근무기록이 있습니다.

회사도 캐나다 직원을 다른 나라의 해외 사무소로 파견한 기록을 보유하고 있습니다.

이 경우에는 기존 고용관계(existing employment relationship)와 상호고용 구조를 설명할 가능성이 있습니다.

물론 이 사실만으로 자동 승인되는 것은 아니며, 회사와 신청인이 C20의 모든 요건을 입증해야 합니다.

사례 2: 캐나다 근무를 위해 새롭게 채용된 직원

박 씨는 해외 회사에서 근무한 적이 없습니다.

캐나다 회사가 박 씨를 새로 채용했고, 근로계약 시작일은 캐나다 입국일로 정해졌습니다.

회사에 해외 법인이 있더라도 박 씨가 그 해외 법인의 직원으로 실제 근무한 기록은 없습니다.

해외 직원이면 무조건 C20 워크퍼밋을 받을 수 있을까요?

신청인도 자신이 C20 범주의 요건을 충족한다는 증빙을 워크퍼밋 신청서에 제출해야 합니다.

IRCC는 필요한 경우 실제 인력교류 규모와 상호고용 여부를 확인하기 위한 추가 서류나 데이터를 요청할 수 있습니다.

어떤 회사나 기관이 영향을 받을 수 있을까요?

C20 상호고용 범주는 여러 국가에서 인력을 운영하는 조직과 관련될 수 있습니다.

이번 기준 변경 이후에는 단순한 캐나다 오퍼레터만 제출하는 방식으로는 충분하지 않을 수 있습니다.

신청인의 해외 재직관계와 회사의 국제 인력교류를 함께 보여주는 것이 중요합니다.

사건에 따라 다음과 같은 자료를 검토할 수 있습니다.

그러면 신청은 어떻게 될까요?

신청인이 현재 해외 직원이 아니거나, 회사가 상호고용을 충분히 입증하지 못하면 C20 워크퍼밋이 거절될 수 있습니다.

C20이 안 되면 캐나다 워크퍼밋을 받을 수 없는 건가요?

C20을 사용할 수 없다고 해서 모든 캐나다 워크퍼밋이 불가능한 것은 아닙니다.

신청인의 국적, 경력, 회사 구조, 직책과 캐나다에서 수행할 업무에 따라 다른 방법을 검토할 수 있습니다.

예를 들어 다음과 같은 가능성이 있을 수 있습니다.

  • 다른 International Mobility Program 면제범주
  • 요건을 충족하는 경우 사내전근자 워크퍼밋
  • 캐나다와 다른 국가 사이의 자유무역협정

사내전근자 워크퍼밋과 같은 제도인가요?

C20 상호고용과 사내전근자, 즉 Intra-Company Transferee 워크퍼밋은 서로 다른 제도입니다.

둘 다 해외 회사와 캐나다 회사의 관계 또는 신청인의 해외 근무경력이 중요할 수 있지만, 회사의 지배관계, 해외 근무기간, 직책, 전문지식과 캐나다에서 수행할 업무 등 적용요건은 서로 다릅니다.

따라서 회사 내부에서 캐나다로 이동한다는 사실만으로 사내전근자나 C20 중 하나가 자동 적용되는 것은 아닙니다.

앞으로 어떻게 준비해야 할까요?

이번 변경 이후에는 오퍼레터를 받은 뒤 워크퍼밋 코드를 선택하는 방식보다, 먼저 고용관계의 구조를 분석하는 것이 중요합니다.

신청 전 다음 내용을 확인하는 것이 좋습니다.

신청인 확인사항

  • 나는 신청 전에 해외 회사에서 실제로 근무했는가?
  • 근무기간과 급여 지급을 입증할 수 있는가?
  • 캐나다에서 맡을 업무가 기존 해외 업무와 연결되는가?

따라서 “LMIA가 필요 없다”는 설명만 듣고 신청하기보다 다음 사항을 먼저 확인해야 합니다.

  • 어떤 LMIA 면제코드를 사용하는지
  • 해당 코드의 법적 요건이 무엇인지
  • 현재 고용관계를 어떻게 입증할 것인지
  • 상호고용을 어떤 자료로 설명할 것인지
  • C20이 불가능할 경우 어떤 대체경로가 있는지

캐나다 워크퍼밋은 오퍼레터만 있으면 자동으로 받을 수 있는 허가가 아닙니다.

Canada Work Permit Rule Change: Newly Hired Employees May No Longer Qualify

Receiving a Canadian job offer does not automatically mean that a foreign worker qualifies for an LMIA-exempt work permit.

Immigration, Refugees and Citizenship Canada has clarified an important eligibility requirement for work permits issued under the C20 Reciprocal Employment category.

Under the updated instructions, a foreign national must already be a current employee of the company abroad before the work permit application is submitted. A person who is newly hired and plans to begin employment only after arriving in Canada may not qualify under this category.

What is a C20 Reciprocal Employment work permit?

Most Canadian employers must obtain a Labour Market Impact Assessment, commonly referred to as an LMIA, before hiring a foreign worker.

Some workers, however, may qualify for an LMIA exemption under the International Mobility Program.

C20 is the administrative exemption code used for certain reciprocal employment arrangements under paragraph 205(b) of the Immigration and Refugee Protection Regulations.

The purpose of the category is to allow foreign nationals to work in Canada when the arrangement also creates or maintains employment opportunities abroad for Canadian citizens or permanent residents.

What has changed?

The updated IRCC guidance clearly states that the foreign national must be currently employed by the company abroad.

An employer–employee relationship must already exist within the organization outside Canada before the work permit application is submitted.

A worker who begins employment with the company only upon arrival in Canada may not satisfy the purpose of reciprocal employment because there has been no prior opportunity to exchange organizational knowledge, professional experience, or internal expertise.

Why does this matter for new hires?

Consider two different situations.

In the first situation, an employee has worked for an overseas branch of a multinational company for two years. The company transfers the employee to Canada, and the worker can provide employment contracts, payroll records, job descriptions, and proof of actual overseas employment.

In the second situation, a Canadian company hires a new worker abroad. The worker has never worked for the company’s overseas office, and the employment contract begins on the date the worker arrives in Canada.

The first situation may support an existing employment relationship.

The second may be treated as a new hire arrangement rather than reciprocal employment.

Is being a current overseas employee enough?

No.

Current overseas employment is an important requirement, but it does not automatically establish eligibility.

The employer must also explain how the Canadian position creates or maintains reciprocal employment opportunities for Canadian citizens or permanent residents abroad.

The applicant must provide evidence showing that the requirements of the C20 category are met.

IRCC officers may request additional documents or data to verify the number, duration, and level of reciprocal employment positions.

What documents may be important?

Depending on the circumstances, relevant evidence may include:

  • an overseas employment contract
  • a letter confirming current employment
  • payroll records
  • bank records showing salary payments
  • evidence of the overseas employment start date
  • overseas and Canadian job descriptions
  • corporate organizational charts
  • evidence of the relationship between the Canadian and overseas entities
  • international mobility policies
  • human resources plans
  • records of Canadians working at overseas offices
  • exchange agreements between participating organizations

The documents should tell one consistent story.

A newly issued employment letter will not necessarily establish a genuine overseas employment relationship when the other records do not show actual employment, duties, or salary payments.

What could happen if the requirements are not met?

When an officer is not satisfied that the C20 requirements have been met, the work permit application may be refused.

IRCC may also advise that an LMIA is required before the work permit can be considered under a different process.

Applicants may encounter wording such as:

  • not currently employed by the company abroad
  • no existing employer–employee relationship
  • insufficient evidence of reciprocity
  • eligibility requirements not met
  • LMIA required
  • work permit refusal

The proper response depends on whether the problem involves missing evidence or an incorrect work permit category.

What should applicants do now?

Applicants should confirm the following before applying:

  • Was the applicant genuinely employed by the overseas company before the application?
  • Can the applicant prove the employment period, salary, and duties?
  • Do the overseas and Canadian roles form part of a genuine international mobility arrangement?
  • Are the dates in the employment contract, payroll records, and support letters consistent?
  • Is the applicant an existing employee or a newly recruited worker?

What should employers review?

Employers should determine whether they can demonstrate genuine reciprocal employment.

They should review:

  • their international mobility or HR policy
  • the number of foreign workers entering Canada
  • the number of Canadians or permanent residents working abroad
  • the duration and level of the positions
  • the explanation submitted through the Employer Portal
  • whether the selected LMIA exemption code accurately reflects the employment arrangement

Using C20 simply because the company has an overseas office may not be sufficient.

Are other work permit options available?

Failure to qualify under C20 does not necessarily mean that no Canadian work permit option is available.

Depending on the worker’s nationality, position, experience, employer structure, and proposed duties, another International Mobility Program exemption may apply.

In other cases, an employer may need to obtain an LMIA under the Temporary Foreign Worker Program.

An intra-company transferee work permit may also be considered when the corporate relationship, overseas employment period, position, and other legal requirements are met.

These categories are not interchangeable. Each option must be assessed on its own requirements.

What about applications already submitted?

Applicants with a pending C20 work permit application should review whether the existing overseas employment relationship was clearly documented.

They should also check whether the employer’s information in the Employer Portal is consistent with the applicant’s employment records and supporting documents.

Where IRCC requests additional information, the response should directly address the eligibility concern rather than simply submitting a large quantity of unrelated documents.

Conclusion

The C20 Reciprocal Employment category is not intended to operate as a general LMIA exemption for every foreign worker hired by an international company.

The applicant must already be employed by the organization abroad before the application is submitted, and the employer must demonstrate a genuine reciprocal employment arrangement.

Newly hired workers whose employment begins only after arrival in Canada may need to consider another LMIA exemption or an LMIA-based work permit.
