캐나다 eTA가 Criminal Inadmissibility로 거절됐다면?
캐나다 전자여행허가(eTA)를 신청했다가 과거 범죄경력 때문에 criminal inadmissibility를 이유로 거절되는 경우가 있습니다.
이때 가장 많이 생기는 질문은 단순히 “다시 신청할 수 있나요?”가 아닙니다.
“GCMS를 받을 때까지 기다려야 하나요?”
“eTA를 다시 신청하면서 판결문과 Legal Submission을 같이 낼 수 있나요?”
“심사관이 추가서류 제출기회도 주지 않고 다시 거절하면 어떻게 하나요?”
“eTA와 Temporary Resident Permit(TRP)은 무엇이 다르며, 둘을 같이 신청해야 하나요?”
“시간이 지나면 자동으로 문제가 없어지는 것인가요, 아니면 Criminal Rehabilitation을 따로 신청해야 하나요?”

이 질문들은 서로 연결되어 있지만 적용되는 절차와 법률적 목적은 서로 다릅니다.
핵심은 eTA 재신청, TRP, Criminal Rehabilitation을 모두 같은 종류의 신청으로 생각하지 않는 것입니다. 각각 해결하려는 문제가 다릅니다.
1. eTA 거절레터에 Criminal Inadmissibility가 적혀 있다면
과거 외국에서 범죄로 유죄판결을 받았거나 일정한 범죄행위를 한 사실이 있는 경우, 캐나다 이민법상 inadmissibility 문제가 발생할 수 있습니다.
특히 외국의 범죄가 캐나다에서 행해졌다면 어떤 Canadian offence에 해당하는지를 판단하는 Canadian equivalency가 중요한 쟁점이 됩니다.
단순히 외국의 죄명을 영어로 번역해서 캐나다의 비슷한 죄명을 찾는 것이 전부는 아닙니다.
실제 검토에서는 다음과 같은 사항이 중요할 수 있습니다.
외국에서 정확히 어떠한 처분을 받았는가
유죄판결(conviction)인지, 기소유예나 불기소 등 유죄판결이 아닌 처분인지 구분할 필요가 있습니다.
캐나다에서는 어떤 범죄에 대응하는가
외국 범죄의 법률상 구성요건과 Canadian offence의 essential elements가 실제로 대응하는지 검토해야 합니다.
실제 인정된 범죄사실은 무엇인가
외국 법률의 범위가 Canadian offence보다 넓은 경우에는 실제 판결문이나 처분자료에 인정된 사실관계도 중요해질 수 있습니다.
Canadian offence의 분류는 무엇인가
캐나다에서는 summary, indictable 또는 hybrid offence인지에 따라 immigration inadmissibility 분석이 달라질 수 있습니다.
IRCC도 범죄를 저질렀거나 본인이 inadmissible할 가능성이 있다고 생각하는 경우라도 eTA를 신청할 수 있고, 신청 과정에서 자신의 상황을 설명할 기회가 있다고 안내합니다.
2. GCMS를 받아야만 다시 움직일 수 있을까요?
반드시 그렇지는 않습니다.
거절레터에 이미 criminal inadmissibility 조항이 명시되어 있다면 큰 틀에서 거절의 법적 근거는 확인된 상태일 수 있습니다.
GCMS의 가치는 다른 곳에 있습니다.
예를 들어 다음 내용을 확인하는 데 도움이 될 수 있습니다.
- 담당 심사관이 어느 외국 범죄를 문제 삼았는지
- 어떤 Canadian offence와 대응시켰는지
- Canadian equivalency 분석을 어떻게 했는지
- 여러 사건이 있는 경우 각각을 conviction 또는 conduct로 어떻게 평가했는지
- 제출한 판결문이나 검찰자료가 어떻게 검토됐는지
- 내부 referral이나 admissibility review가 있었는지
따라서 GCMS가 있으면 재신청이나 후속 대응을 훨씬 정밀하게 만들 수 있습니다.
그러나 이미 거절조항과 사건자료를 확보하고 있다면 GCMS가 아직 도착하지 않았다는 이유만으로 모든 준비를 중단해야 하는 것은 아닙니다.
또 하나 유의할 점이 있습니다.
IRCC는 현재 대부분의 temporary resident refusal에 officer decision notes를 거절결정과 함께 제공하고 있지만, 이 제도에서 eTA와 TRP는 현재 제외되어 있습니다. 따라서 eTA 사건에서는 여전히 ATIP/GCMS가 내부 reasoning을 확인하는 데 중요한 역할을 할 수 있습니다.
GCMS는 “아무것도 모르기 때문에 기다리는 자료”라기보다, 이미 알고 있는 거절사유를 어떤 reasoning으로 판단했는지 확인하여 다음 대응을 정밀하게 만드는 자료로 보는 것이 보다 정확합니다.
3. GCMS가 나오지 않아도 eTA를 재신청할 수 있을까요?
거절 후 일정 기간을 반드시 기다려야만 다시 eTA를 신청할 수 있는 일반적인 규정은 없습니다.
다만 동일한 사실과 동일한 설명만 반복하여 다시 신청하는 것은 다른 결과를 만들기 어렵습니다.
재신청을 검토한다면 이전 거절을 정확하게 공개하고, 이전 결정에서 문제가 된 부분을 실제로 다룰 새로운 사실·법률적 설명·자료가 무엇인지 먼저 검토할 필요가 있습니다.
예를 들어 criminal inadmissibility 사건이라면 다음과 같은 쟁점을 다시 정리할 수 있습니다.
- 이전 eTA 거절 및 적용된 inadmissibility 조항
- 실제 conviction과 conviction이 아닌 처분의 구분

재신청은 단순히 eTA 신청서를 한 번 더 제출하는 작업이 아니라, 이전 refusal reason을 실제로 어떻게 다룰 것인지가 중요합니다.
4. eTA를 신청할 때 상세 Legal Submission을 바로 첨부할 수 있을까요?
여기에서 일반적인 Visitor Visa와 eTA의 중요한 차이가 있습니다.
eTA 신청서에는 criminal history와 관련된 질문과 설명공간이 존재하지만, 최초 신청단계에서 신청인이 원하는 여러 페이지의 Legal Submission, 판결문, 검찰자료, 판례자료 등을 자유롭게 첨부하는 일반적인 document-upload 구조는 아닙니다.
또한 IRCC는 현재 application update 안내에서 eTA 신청자에게는 요청받지 않은 새 문서를 임의로 제출하지 말고 IRCC가 요청하는 경우에만 보내도록 별도로 안내하고 있습니다.

따라서 복잡한 criminal inadmissibility 사건에서는 두 종류의 설명을 따로 준비하는 방법을 고려할 수 있습니다.
eTA 신청서용 압축 설명

5. “상세 의견서를 제출할 기회를 달라”고 eTA에 적을 수 있을까요?
가능한 설명공간 안에서 그러한 취지를 명시하는 방법을 고려할 수 있습니다.
예를 들어 핵심 사건정보를 설명한 뒤,
관련 법원·검찰자료와 Canadian equivalency에 관한 detailed legal submission이 준비되어 있으므로 adverse decision 전에 이를 제출할 기회를 요청한다는 취지입니다.
이렇게 기재하는 이유는 두 가지입니다.
첫째, 담당 심사관에게 추가적인 material evidence와 legal argument가 존재한다는 점을 알릴 수 있습니다.
둘째, 향후 추가자료 요청 없이 adverse decision이 내려지는 경우에는 재신청 당시부터 추가자료 제출의사를 분명히 밝혔다는 기록이 남게 됩니다.
다만 이 문구를 기재했다고 해서 IRCC가 반드시 Procedural Fairness Letter(PFL)나 Additional Document Request(ADR)를 보내야 하는 것은 아닙니다.
6. IRCC가 추가자료를 요청하면 어떻게 되나요?
IRCC가 eTA 심사 중 추가서류가 필요하다고 판단하면 신청인에게 별도의 안내를 보낼 수 있습니다.
eTA에서 문서제출 요청을 받으면 secure account에 신청을 연결하여 요청된 자료를 확인하고 제출하는 절차가 사용될 수 있습니다. IRCC는 eTA 자료요청을 받은 경우 해당 instructions에 따라 서류를 제출하도록 안내합니다.
이 단계가 열리면 미리 준비한 상세 Legal Submission과 요청받은 supporting documents를 정해진 방식과 기한에 맞추어 제출할 수 있습니다.
따라서 복잡한 사건에서는 IRCC의 요청이 온 다음 처음부터 자료를 만들기 시작하기보다, 신청 전에 핵심 자료를 상당 부분 정리해 두는 것이 실무적으로 도움이 될 수 있습니다.
7. 추가자료 제출기회 없이 바로 다시 거절될 수도 있을까요?
가능성을 배제할 수 없습니다.
Procedural fairness가 모든 eTA 재신청에서 반드시 PFL 한 차례와 PDF upload 기회를 제공해야 한다는 의미는 아닙니다.
신청인이 이미 알고 있는 기존 criminality issue를 바탕으로 재신청했고, officer가 기존 기록과 새 신청서의 설명만으로 판단할 수 있다고 보는 경우에는 추가자료를 다시 요청하지 않고 결정할 가능성도 고려해야 합니다.
따라서 다음과 같이 준비하는 것이 중요합니다.
- 신청서 설명란 자체를 가볍게 작성하지 않기
- 이전 거절을 정확하게 disclose하기
- 중요한 legal issue를 짧게라도 분명하게 제기하기
- 상세 submission이 준비되어 있다는 점과 제출기회를 요청한다는 취지를 남기기
- ADR 또는 PFL이 오면 즉시 제출할 package를 준비해 두기
eTA 재신청의 위험 중 하나는 “상세한 자료를 준비했으니 당연히 제출할 기회가 생길 것”이라고 전제하는 것입니다. 추가자료 요청은 보장되지 않습니다.
8. 아무 기회 없이 다시 거절되면 그것으로 끝일까요?
그렇지는 않습니다.
새로운 eTA가 거절된 경우에는 우선 새 refusal의 내용을 정확하게 검토해야 합니다.
사안에 따라 다음을 검토할 수 있습니다.
Reconsideration Request
IRCC에게 기존 결정을 reopen하여 다시 검토해 달라고 요청하는 방법입니다.
Reconsideration은 정식 statutory appeal이 아니며, decision-maker가 다시 파일을 열 것인지 자체가 재량적입니다.
IRCC가 공개한 자료에서도 temporary resident refusal 이후 reconsideration을 요청할 수 있지만, 단순한 결과에 대한 불만만으로는 충분하지 않고 procedural fairness, natural justice 또는 명백한 오류 등 구체적인 사유가 중요하다고 설명합니다.
이때 eTA 심사 중 충분히 제출하지 못했던 자료가 있다면 그 자료와 legal position을 토대로 왜 reopening이 필요한지 설명하는 방법을 검토할 수 있습니다.
Judicial Review
결정에 법률오류 또는 procedural fairness 문제가 있다고 판단하는 경우 Federal Court의 Judicial Review를 검토할 수 있습니다.
Federal Court proceeding은 별도의 법원절차이고 제소기한이 있으므로 신속한 검토가 필요합니다.
RCIC의 IRCC 신청·재검토 업무와 Federal Court litigation은 구분하여야 합니다.
9. eTA는 보통 얼마나 걸릴까요?
일반적인 eTA는 매우 빠르게 처리되는 경우가 많습니다.
IRCC는 대부분의 신청인이 몇 분 안에 이메일을 받지만, 일부 신청은 처리에 며칠이 필요할 수 있다고 안내합니다.
즉시 결정되지 않는 경우에는 통상 신청 후 72시간 이내에 다음 단계에 관한 이메일을 받을 수 있습니다.
그러나 “72시간 이내에 반드시 승인 또는 거절의 최종결정이 나온다”는 의미는 아닙니다.
특히 기존 criminal inadmissibility refusal이 있거나 추가심사가 필요한 비정형 사건은 일반적인 자동처리 eTA와 같은 속도를 전제로 일정을 잡는 것은 적절하지 않을 수 있습니다.
10. eTA가 승인되면 어떤 의미인가요?
eTA는 일반적으로 최대 5년 또는 해당 eTA에 연결된 여권의 만료일까지 유효하며, 먼저 도래하는 날짜에 종료됩니다.
유효한 eTA가 있는 동안 단기방문을 위해 여러 차례 캐나다로 항공여행을 할 수 있습니다.
그러나 eTA는 입국허가 그 자체는 아닙니다.
캐나다에 도착하면 CBSA border services officer가 실제 입국요건과 admissibility를 다시 확인할 수 있습니다.
따라서 다음 두 문장은 구분해야 합니다.
eTA 승인
캐나다행 항공편으로 여행하여 입국심사를 받을 수 있는 유효한 travel authorization이 있다는 의미입니다.
캐나다 입국
도착 후 border examination을 거쳐 최종적으로 판단됩니다.
기존 criminal history와 과거 refusal을 정확하게 공개한 새로운 eTA가 승인된 경우라면, 일반적으로 같은 criminal inadmissibility를 일시적으로 극복하기 위한 TRP를 별도로 추가할 이유는 없습니다.
그러나 eTA 승인 자체를 “입국 100% 보장”으로 표현해서는 안 됩니다.
11. Temporary Resident Permit(TRP)은 무엇이 다른가요?
TRP는 eTA와 출발점부터 다릅니다.
eTA에서의 질문
신청인이 캐나다로 여행할 자격과 admissibility 요건을 충족하는가?
TRP에서의 질문
신청인에게 inadmissibility가 존재한다고 하더라도, 구체적인 사정을 고려할 때 일정 기간 캐나다 입국 또는 체류를 예외적으로 허용할 충분한 이유가 있는가?
IRCC는 TRP를 compelling reason이 있는 경우에만 officer의 재량으로 발급하며, 캐나다 입국 필요성이 Canadian society에 대한 health or safety risk보다 커야 한다고 설명합니다.
업무출장의 경우에도 단순히 “회사 일 때문에 캐나다에 가고 싶다”는 정도가 아니라 구체적인 필요성을 입증하는 것이 중요합니다.
예를 들면 다음과 같습니다.
- 캐나다 회사 또는 거래처의 invitation
- 확정된 meeting schedule
- 계약협상 또는 프로젝트 일정
- 현장방문 필요성
- 본인의 참석이 필요한 이유
- 다른 직원으로 쉽게 대체하기 어려운 사정
- 짧고 구체적인 체류일정
- 캐나다 출국계획
- 현재 직업과 안정적인 거주상태
- 과거 사건 이후의 생활과 risk 관련 설명
12. eTA가 다시 거절되어야만 TRP를 신청할 수 있나요?
그렇지 않습니다.
이미 본인이 inadmissible하다는 사실을 알고 있는 eTA-required 국가의 국민에게 IRCC는 Web form을 통하여 TRP 신청방법을 요청하도록 현재 별도의 절차를 안내하고 있습니다.

따라서 다음 eTA가 다시 거절될 때까지 기다리는 것이 TRP의 법적 선행조건이라고 볼 수는 없습니다.
실제 전략은 여행의 중요도와 남아 있는 기간에 따라 달라질 수 있습니다.
13. eTA와 TRP를 동시에 진행해야 할까요?
항상 두 절차를 동시에 접수하는 것이 최선인 것은 아닙니다.
실무적으로는 다음과 같은 접근을 생각할 수 있습니다.
eTA 재신청을 먼저 검토하는 경우
기존 inadmissibility 판단 자체에 다툴 법률적·사실적 근거가 있고, 새로운 신청에서 이를 설명할 이유가 있는 경우입니다.
이 경우 eTA에 필요한 legal analysis를 준비하면서 TRP에 활용할 자료도 동시에 정리해 둘 수 있습니다.
eTA가 승인되면 같은 inadmissibility 문제 때문에 TRP를 별도로 진행할 필요는 일반적으로 없어집니다.
TRP까지 일찍 준비할 이유가 있는 경우
출장일이 확정되어 있고 방문의 중요성이 매우 높으며, eTA 심사가 지연되거나 다시 거절된 후부터 TRP를 준비하면 시간적 여유가 부족할 수 있는 경우입니다.
이 경우 TRP용 business-necessity 자료까지 미리 준비해 두는 것이 도움이 될 수 있습니다.
eTA가 다시 거절되는 경우
이미 준비한 criminal records, court records, translations 및 factual background는 TRP에서도 상당 부분 활용할 수 있습니다.
다만 Legal Submission의 결론은 동일하지 않습니다.
eTA에서는 inadmissibility finding 자체를 다투는 논리가 중요할 수 있는 반면,
TRP에서는 설령 inadmissibility가 존재하더라도 이번 방문 필요성이 충분하다는 discretionary relief 논리가 중심이 됩니다.
14. TRP가 승인되면 한 번만 사용할 수 있나요?
반드시 그렇지는 않습니다.
IRCC에 따르면 TRP는 최대 3년까지 발급될 수 있습니다.
그러나 실제 validity period는 officer가 개별 사건의 필요성과 사정을 고려하여 결정합니다.
또한 매우 중요한 제한이 있습니다.
TRP는 일반적으로 캐나다를 출국하면 더 이상 유효하지 않으며, permit 자체에 re-entry가 가능하다고 명시되어 있는 경우에만 다시 사용할 수 있습니다.
따라서 향후 반복적인 캐나다 출장이 예상된다면 다음을 구분해서 검토해야 합니다.
단일 업무출장
특정 회의나 프로젝트를 위한 한 차례의 단기 방문
반복적인 업무출장
업무성격상 캐나다를 일정 기간 반복 방문해야 하는 경우
후자의 경우에는 반복 방문의 실제 필요성을 자료로 설명하고 적절한 validity 및 re-entry를 요청하는 방안을 검토할 수 있지만, 이를 얼마 동안 허용할지는 officer가 결정합니다.
15. TRP가 있으면 캐나다 입국이 보장되나요?
TRP 역시 100% 입국보장이라는 표현은 적절하지 않습니다.
다만 eTA와는 법적 의미가 다릅니다.
eTA는 travel authorization인 반면, TRP는 inadmissibility가 있음에도 불구하고 일정 기간 예외적으로 temporary resident가 될 수 있도록 하는 permit입니다.
해외 TRP가 승인되면 IRCC는 여행을 위한 counterfoil과 입국 시 border services officer에게 제시할 안내를 제공하고, 캐나다 도착 후 officer가 entry를 authorize하면 실제 TRP status document가 발급됩니다.
따라서 이미 알려진 inadmissibility를 전혀 해결하지 않은 채 단순 eTA만 소지한 경우와, 그 inadmissibility를 전제로 TRP가 승인된 경우는 동일하지 않습니다.
그러나 TRP 역시 조건 위반, 새로운 문제 또는 border examination 결과 등 모든 상황을 무시하고 입국을 무조건 보장하는 문서는 아닙니다.
16. Criminal Rehabilitation은 언제 필요한가요?
TRP가 특정 방문에 대한 임시적인 해결방법이라면 Criminal Rehabilitation은 보다 장기적인 해결방법입니다.
Individual Rehabilitation이 승인되면 해당 criminal inadmissibility를 법적으로 극복하는 효과가 있으므로 향후 반복적인 캐나다 방문이 필요한 사람에게 중요할 수 있습니다.
일반적으로 외국 conviction이 문제되는 경우에는 모든 sentence가 종료된 후 최소 5년이 경과해야 Individual Rehabilitation을 신청할 수 있습니다.
conviction이 아니라 외국에서 committed an act가 inadmissibility의 근거가 되는 경우에는 해당 행위일부터 5년이 문제될 수 있습니다.
여기에서 sentence completion은 단순 판결일과 같지 않을 수 있습니다.
사안에 따라 다음을 확인해야 합니다.
- 벌금 완납일
- probation 종료일
- restitution 완료일
- licence suspension 종료
- 기타 법원이 부과한 조건 종료
또한 eTA가 필요한 외국인의 경우 IRCC는 criminal rehabilitation을 별도로 신청하여 승인받은 후 eTA를 신청하는 구조를 안내하고 있습니다.
17. 시간이 지나면 자동으로 Rehabilitation이 되는 경우도 있나요?
Criminal Rehabilitation에는 Individual Rehabilitation과 Deemed Rehabilitation을 구분할 필요가 있습니다.
Individual Rehabilitation
법정 대기기간을 충족한 후 별도의 신청을 하고 IRCC의 승인을 받아야 합니다.
단순히 5년이 지났다고 자동으로 승인되는 것이 아닙니다.
Deemed Rehabilitation
범죄의 종류, 범죄 수, Canadian equivalent의 최고형, sentence 종료 후 경과기간 등 법정 조건을 충족하면 별도 rehabilitation application 없이 deemed rehabilitated로 평가될 수 있는 경우가 있습니다.
대표적으로 특정 조건을 충족하는 한 건의 indictable-equivalent offence의 경우 sentence 종료 후 최소 10년이라는 기간이 문제될 수 있습니다.
그러나 “10년이 지났으니 시스템이 자동으로 eTA를 승인한다”는 의미는 아닙니다.
실제 eTA 신청이나 입국심사에서 범죄기록과 rehabilitation 요건을 다시 확인할 수 있으므로, 적용요건을 정확히 검토해야 합니다.

그 자체가 inadmissibility를 없애주는 신청은 아닙니다.
eTA 재신청
기존 거절사유를 다시 검토받으면서 현재 travel authorization 요건을 충족하는지를 판단받는 절차입니다.
TRP
inadmissibility가 있다고 하더라도 compelling temporary need를 근거로 예외적인 입국·체류를 요청하는 절차입니다.
Criminal Rehabilitation
장기적으로 underlying criminal inadmissibility 자체를 해결하기 위한 절차입니다.
Reconsideration
이미 내려진 refusal에 구체적인 오류나 fairness issue 등이 있다고 판단되는 경우 IRCC에게 기존 결정을 reopen해 달라고 요청하는 비정형·재량적 절차입니다.
Judicial Review
결정의 합리성 또는 법률·절차적 오류를 Federal Court에서 다투는 별도의 법원절차입니다.
20. 실제로 어떤 순서로 준비해야 할까요?
모든 사건에 동일한 순서가 적용되는 것은 아닙니다.
그러나 이미 criminal inadmissibility로 eTA가 거절되었고 가까운 시기에 중요한 캐나다 방문계획이 있다면 다음 질문을 순서대로 검토할 수 있습니다.

Canadian eTA Refused for Criminal Inadmissibility: What Can You Do Next?
A Canadian Electronic Travel Authorization application may be refused where an applicant’s past criminal history raises an issue of criminal inadmissibility.
In a complex case, the key question is rarely limited to whether the applicant can simply submit another eTA.
Applicants may need to consider several different issues:
“Should I wait for my GCMS records before reapplying?”
“Can I submit a detailed legal brief and court records with a new eTA?”
“What if IRCC refuses the new eTA without giving me an opportunity to submit those documents?”
“How is a Temporary Resident Permit different from an eTA?”
“Should I apply for an eTA first or prepare a TRP at the same time?”
“Will the inadmissibility disappear automatically after enough time has passed?”
These procedures serve different legal purposes and should not be treated as interchangeable.
The central issue is to distinguish an eTA reapplication, a Temporary Resident Permit and Criminal Rehabilitation. Each addresses a different immigration problem.
1. What does a criminal inadmissibility eTA refusal mean?
Where a person has been convicted of an offence outside Canada, or has engaged in certain criminal conduct outside Canada, Canadian immigration law may require an analysis of whether that foreign offence or conduct corresponds to an offence under Canadian law.
This is commonly referred to as Canadian equivalency analysis.
The analysis is not necessarily resolved by translating the foreign offence title into English and finding a Canadian offence with a similar name.
Depending on the facts, important questions may include:
What was the actual foreign disposition?
Was there a conviction, or was the matter resolved through a prosecutorial disposition that did not result in a conviction?
What is the potential Canadian equivalent?
The legal ingredients of the foreign offence may need to be compared with the essential elements of the potential Canadian offence.
What facts were actually established?
Where the scope of the foreign offence is broader than its Canadian counterpart, the factual findings in the judgment or prosecutorial record may become particularly important.
How is the Canadian offence classified?
The Canadian offence may be summary, indictable or hybrid, and that classification may materially affect the immigration analysis.
IRCC expressly states that a person who has committed an offence and suspects or knows that they may be inadmissible may still apply for an eTA, and that the application gives the applicant an opportunity to explain the situation.
2. Must you wait for GCMS before taking any further step?
Not necessarily.
If the refusal letter already identifies criminal inadmissibility as the legal basis for refusal, the broad issue may already be known.
GCMS can nevertheless be extremely useful because it may help determine:
- which foreign offence the officer relied on
- which Canadian offence was identified
- how the officer approached equivalency
- how different criminal incidents were categorized
- whether a non-conviction disposition was treated as relevant conduct
- whether important court or prosecutorial records were considered
- whether the file was referred for an internal admissibility review
GCMS therefore often improves the precision of a later submission.
It should not always be viewed as a document without which no analysis can begin.
Another practical point is that IRCC’s current policy of providing officer decision notes with many temporary resident refusals does not presently include eTA and TRP decisions. This can make ATIP/GCMS particularly relevant in these cases.
3. Can you reapply for an eTA without GCMS?
There is generally no mandatory waiting period simply because a prior eTA was refused.
However, submitting substantially the same facts and explanation again may result in substantially the same decision.
Before reapplying, it may be necessary to identify:
- the prior refusal and statutory ground
- the exact criminal disposition
- whether any matter did not result in a conviction
- the Canadian equivalency issue
- the facts established in the court or prosecutorial record
- the date on which all sentencing conditions were completed
- what information was provided in the prior application
- what genuinely new or different legal or factual material can now be presented
A reapplication should therefore be approached as a response to the previous refusal, not simply as another attempt at the online form.
4. Can a full Legal Submission be uploaded with the initial eTA?
The eTA process differs from many regular visa applications.
The application contains background questions and spaces in which relevant circumstances can be explained.
However, it is not structured as an unrestricted initial upload process in which the applicant can simply attach a lengthy legal memorandum, multiple court records and a complete evidentiary package at will.
IRCC’s current application-update instructions specifically state that eTA applicants should send new documents only if IRCC requests them.
For a complex criminal inadmissibility matter, it may therefore be useful to prepare two separate levels of explanation.
Concise eTA explanation
The limited text available in the application can be used to identify:
- the prior refusal
- the relevant criminal disposition
- the central equivalency issue
- any non-conviction disposition
- the existence of additional material evidence
- the availability of a detailed legal submission
Full Legal Submission
A separate detailed package can be prepared in advance and may include:
- chronology
- foreign court and prosecutorial records
- Canadian statutory analysis
- element-by-element equivalency
- sentence-completion evidence
- certified translations
- immigration-law submissions
- other supporting evidence
5. Can the applicant ask IRCC for an opportunity to submit the full package?
Where space permits, the applicant may consider stating that material court and prosecutorial records and a detailed Canadian equivalency submission are available and respectfully requesting an opportunity to provide them before an adverse decision is made.
This does not create an automatic right to a Procedural Fairness Letter or an Additional Document Request.
It can, however, make clear on the record that additional material evidence exists and that the applicant has asked to provide it.
6. What happens if IRCC asks for additional documents?
If IRCC determines that further documents are required to process an eTA, the applicant may receive instructions to link the eTA to a secure account and upload the requested material.
IRCC expressly provides procedures for eTA applicants who have been asked to provide documents.
Where a full legal package has already been prepared, the applicant can respond more quickly to a short submission deadline.
7. Can IRCC refuse again without requesting the full submission?
That possibility should not be ignored.
Procedural fairness does not necessarily mean that every eTA reapplication must generate a new PFL, ADR or unrestricted PDF-upload opportunity.
Where the applicant already knows the adverse issue and the officer considers the existing record and new application sufficient to make a decision, the officer may potentially proceed without another document request.
For that reason, applicants should not assume that preparing a detailed legal package guarantees an opportunity to upload it during the pending eTA.
8. What happens if the second eTA is refused without a document request?
A further refusal does not necessarily exhaust every possible remedy.
The next step depends on the new decision and the record.
Reconsideration
A request may be made asking IRCC to reopen and reconsider a previous temporary resident decision.
Reconsideration is not a statutory appeal.
The decision-maker has discretion as to whether the file should be reopened, and mere disagreement with the result is generally not enough.
Relevant circumstances may include a material error, procedural fairness issue or other concrete reason why reconsideration is justified.
Federal Court Judicial Review
Where there may be an unreasonable decision, legal error or procedural fairness issue, Federal Court judicial review may also need to be considered.
Court proceedings have strict filing deadlines and require separate Canadian litigation counsel.
9. How quickly is an eTA decided?
Most ordinary eTA applications are processed quickly.
IRCC states that most applicants receive an email within minutes, although some applications may take several days.
Where an application is not immediately finalized, IRCC indicates that the applicant can expect an email within approximately 72 hours explaining the next steps.
This does not mean that every eTA will receive a final approval or refusal within 72 hours.
A criminal inadmissibility case with a prior refusal should not be scheduled on the assumption that it will follow the timeline of a routine automated application.
10. What does an approved eTA provide?
An approved eTA is generally valid for up to five years or until the passport expires, whichever occurs first.
While the eTA remains valid, the traveller can normally fly to Canada multiple times for short visits.
An eTA does not, however, guarantee admission to Canada.
The final examination occurs at the Canadian port of entry.
If a new eTA was approved after full and accurate disclosure of the prior refusal and relevant criminal history, a separate TRP would not ordinarily be required merely to address the same criminal inadmissibility issue.
11. How is a Temporary Resident Permit different?
A TRP addresses a different question.
An eTA generally requires the applicant to satisfy Canada’s travel and admissibility requirements.
A TRP may permit a foreign national who is inadmissible to enter or remain in Canada temporarily where the circumstances justify an exception.
IRCC requires a compelling reason and states that the applicant’s need to enter or remain in Canada must outweigh the relevant health or safety risks to Canadian society.
In a genuine business-travel matter, relevant evidence may include:
- a Canadian invitation
- employer letters
- confirmed meetings
- contract or project schedules
- the applicant’s required personal attendance
- reasons the trip cannot readily be delegated
- a short and defined itinerary
- evidence of stable employment and residence outside Canada
- return plans
- evidence relevant to the applicant’s current risk
12. Must a second eTA be refused before a TRP can be pursued?
No.
IRCC’s current instructions specifically provide a route for nationals of eTA-required countries who already know that they are inadmissible.
Such applicants may submit an IRCC Web form and request instructions on how to apply for a TRP as an eTA-required traveller.
Accordingly, another eTA refusal is not necessarily a legal prerequisite to TRP consideration.
13. Should an eTA and TRP always be filed together?
Not necessarily.
A reasonable strategy depends on urgency and the strength of the admissibility argument.
Where an eTA reapplication may be considered first
There may be a genuine legal or factual basis to challenge or revisit the prior inadmissibility finding.
The eTA position can be prepared while the applicant simultaneously gathers the evidence that would be needed if a TRP later becomes necessary.
If the eTA is approved, a TRP for the same inadmissibility issue would ordinarily no longer be necessary.
Where early TRP preparation may be important
The trip may be fixed, commercially important and difficult to postpone.
Waiting for another eTA refusal before beginning TRP preparation could leave insufficient time.
In that situation, the applicant can gather the TRP evidence while the eTA strategy is being assessed.
14. How long can a TRP remain valid?
A TRP may be issued for up to three years.
The actual validity period is determined by the officer based on the individual circumstances.
A TRP also generally becomes invalid when the holder leaves Canada unless the permit specifically authorizes re-entry.
This makes it important to distinguish between:
A single urgent trip
A defined business or personal visit for a limited period.
Repeated business travel
A role that may require several Canadian visits during a defined period.
Where repeated travel is genuinely required, the supporting submission may explain that need and request appropriate validity and re-entry authorization. The final decision remains with the officer.
15. Does a TRP guarantee entry?
A TRP should not be described as an absolute guarantee of admission.
It does, however, have a different legal function from an eTA because it specifically addresses the inadmissibility that would otherwise prevent temporary admission.
For an approved outside-Canada TRP request, IRCC may place a TRP counterfoil in the passport and provide a letter for presentation to the border services officer.
If entry is authorized at the port of entry, the officer issues the TRP status document specifying the authorized period of stay.
16. What is Criminal Rehabilitation?
Criminal Rehabilitation is a longer-term mechanism for overcoming criminal inadmissibility.
Where the inadmissibility results from a foreign conviction, an applicant generally must wait at least five years after completion of all elements of the sentence before becoming eligible to apply for Individual Rehabilitation.
Where the inadmissibility is based on having committed an act outside Canada, the relevant five-year period may instead run from the act.
Sentence completion can include more than a conviction date.
It may be necessary to confirm:
- payment of all fines
- completion of probation
- restitution
- licence suspension
- other sentencing conditions
For an eTA-required foreign national, IRCC currently instructs applicants seeking criminal rehabilitation to make the rehabilitation application separately before applying for the eTA.
17. Does rehabilitation ever occur without a formal application?
Canadian law also recognizes deemed rehabilitation in certain circumstances.
Eligibility depends on the number and seriousness of offences, the Canadian equivalent offence, the maximum Canadian penalty and the amount of time that has passed since completion of the sentence.
For some qualifying cases involving one indictable-equivalent offence punishable in Canada by less than ten years, a ten-year period after completion of the sentence may be relevant.
Deemed rehabilitation does not mean that an electronic system automatically erases the criminal history.
The legal requirements may still need to be demonstrated when admissibility is assessed.
18. Documents that may need to be prepared
A criminal inadmissibility file may require review of several categories of evidence.

19. Keep the different procedures separate
GCMS
Helps reveal the reasoning and processing history behind the earlier decision.
eTA reapplication
Asks IRCC to assess a new travel authorization application in light of the applicant’s current information and prior refusal.
TRP
Seeks temporary relief despite inadmissibility where compelling circumstances justify entry or stay.
Criminal Rehabilitation
Seeks a longer-term resolution of the underlying criminal inadmissibility.
Reconsideration
Asks IRCC, on a discretionary basis, to reopen a prior decision.
Judicial Review
Challenges an immigration decision before the Federal Court where appropriate.
20. Practical preparation before deciding the next step
Before choosing a strategy, it can be useful to ask:
- What exact provision appears in the refusal letter?
- What criminal records were previously submitted?
- Is GCMS needed to identify the officer’s reasoning?
- Is there a genuine Canadian equivalency issue?
- What can realistically be stated in the limited eTA explanation?
- Is a full Legal Submission ready if IRCC requests documents?
- What happens if there is no additional-document request?
- Is the proposed Canadian trip optional or genuinely compelling?
- Is there enough time to consider a TRP if the eTA is refused or delayed?
- When does Criminal Rehabilitation eligibility arise?
A criminal inadmissibility eTA case should not be treated as merely submitting the same online form again. The prior refusal, Canadian equivalency, document-submission limitations, temporary TRP relief and long-term Rehabilitation options should be considered as separate parts of one overall strategy.
