Work Permit·Study Permit과 TRV는 역할이 다릅니다
캐나다에서 가장 많이 생기는 혼동 중 하나가 Permit과 Visa를 같은 문서로 생각하는 것입니다.
- Work Permit은 캐나다에서 정해진 조건에 따라 일할 수 있는 권한과 체류조건을 보여주는 문서입니다.
- Study Permit은 캐나다에서 허가된 학업을 할 수 있는 조건을 보여주는 문서입니다.
- **TRV(Visitor Visa)**는 비자가 필요한 국적의 사람이 캐나다로 여행해 입국심사를 받을 때 사용하는 여행서류입니다.
IRCC도 캐나다 안에서 Worker 또는 Student가 새 Visitor Visa를 신청하는 안내에서 “Work Permit 또는 Study Permit은 Visa가 아니다”라고 명확히 설명합니다. Permit을 연장했다고 해서 TRV가 자동으로 연장되는 것도 아닙니다.

따라서 “TRV가 거절됐으니 Work Permit도 거절된 것”이라고 바로 결론 내리면 안 됩니다. 반대로 “Work Permit이 살아 있으니 TRV가 없어도 해외에 다녀올 수 있다”고 생각하는 것도 위험합니다.
TRV가 거절되면 현재 Work Permit도 자동으로 취소되나요?
일반적으로 별도의 TRV 신청이 거절됐다는 사실 하나만으로 유효한 Work Permit이 자동 취소되는 구조는 아닙니다.
현재 「Immigration and Refugee Protection Regulations」 제209조는 Work Permit이 무효가 되는 시점을 Permit 만료 또는 규정상 정해진 취소 사유에 따른 cancellation과 연결하고 있습니다. 단순히 별도의 TRV 신청이 거절됐다는 사실은 제209조에 적힌 자동 무효 사유가 아닙니다.

Study Permit도 별도의 규정이 있습니다. IRPR 제222조는 학업 완료 후 90일, 지정교육기관 등록상태, Permit 취소 또는 만료 등 Study Permit이 무효가 되는 사유를 규정합니다.

즉, TRV refusal과 Permit validity는 같은 질문이 아닙니다.
다만 여기에는 매우 중요한 예외적 상황이 있습니다. TRV 거절레터나 심사기록에 다음과 같은 내용이 포함되어 있다면 별도 검토가 필요합니다.
- 과거 신청서의 허위정보 또는 중요 사실 누락
- Misrepresentation 가능성
- Criminal, medical 또는 다른 inadmissibility 문제
- 기존 Permit이 별도 절차로 취소됐다는 통지
- 현재 신분 또는 Permit 조건 위반 문제
- Removal 또는 enforcement와 연결되는 기록
이 경우 “TRV만 거절됐다”는 전제 자체가 맞지 않을 수 있습니다. 거절레터 제목만 보지 말고 결정 이유와 별도 통지서 전체를 확인해야 합니다.
캐나다 안에 그대로 있으면 계속 일하거나 공부할 수 있나요?
현재 Work Permit 또는 Study Permit이 실제로 유효하고, 별도 취소나 신분상실 사유가 없으며, Permit 조건을 계속 충족하고 있다면 TRV refusal만을 이유로 즉시 일을 중단하거나 학업을 중단해야 한다고 단정할 수는 없습니다.
Temporary resident의 체류기간과 조건은 TRV 스티커의 만료일만으로 정해지지 않습니다. IRPR 제183조는 Temporary Resident의 authorized stay와 Permit의 유효성을 연결해 규정합니다.

하지만 다음 항목은 별도로 확인해야 합니다.
- 현재 Permit에 적힌 만료일
- Employer-specific Work Permit이라면 고용주·직무·근무지 조건
- Study Permit이라면 DLI 등록과 학업조건
- Permit 연장 신청 중이라면 maintained status가 실제로 성립하는지
- TRV 거절과 별개로 받은 IRCC 또는 CBSA 서신이 있는지
특히 “Permit 카드에 날짜가 남아 있다”는 사실만 확인하고 끝내지 마십시오. Study Permit은 특정 상황에서 인쇄된 만료일 전에 무효가 될 수 있고, Work Permit 역시 규정상 cancellation이 있다면 별개 문제가 됩니다.
가장 큰 문제는 출국 후 재입국입니다
TRV가 거절된 상태에서 가장 현실적인 위험은 캐나다 안에서의 당장 체류보다 해외여행 후 돌아오는 단계에서 생기는 경우가 많습니다.
IRCC는 Work Permit이 travel document가 아니라고 명시합니다. 캐나다로 다시 여행하려면 국적과 여행방식에 따라 유효한 TRV 또는 eTA가 필요할 수 있습니다.

Study Permit은 유효하지만 TRV가 없는 경우

여행이 꼭 필요한 경우
출국 전에 “Permit이 있으니 어떻게든 돌아올 수 있다”는 전제로 항공권을 확정하기보다, 본인의 국적상 필요한 여행서류, TRV refusal의 이유, 새 신청 가능성, 여행 시점과 Permit 만료일을 함께 확인해야 합니다.
미국 또는 Saint-Pierre-et-Miquelon만 다녀오는 예외는 어떻게 보나요?
IRPR에는 일정한 Temporary Resident가 오직 미국 또는 Saint-Pierre-et-Miquelon을 방문하고, 출국 전 발급된 유효한 Work Permit 또는 Study Permit 등을 보유하며, authorized stay가 끝나기 전에 캐나다로 돌아오는 경우 적용될 수 있는 제한적인 TRV 면제 규정이 있습니다.
이 예외는 “TRV가 없어도 어디든 해외여행할 수 있다”는 일반 규칙이 아닙니다. 여행경로가 다른 국가를 포함하는지, 현재 authorized stay가 유지되는지, Permit과 여권이 유효한지 등 조건을 정확히 봐야 합니다.
따라서 TRV refusal 직후 미국 방문을 계획하는 경우에도 본인에게 이 예외가 실제 적용되는지 확인하지 않고 여행하는 것은 피하는 편이 안전합니다.
왜 캐나다 안에서 낸 TRV가 거절될 수 있나요?
유효한 Work Permit이나 Study Permit이 있다고 해서 TRV가 자동 승인되는 것은 아닙니다.
IRCC의 in-Canada Visitor Visa 절차는 캐나다 안에 있고 유효한 Work Permit 또는 Study Permit을 가진 Worker·Student에게 별도의 TRV 신청 경로를 제공하지만, 실제 Visa 요건을 충족하는지는 별도로 심사합니다.
거절 사유는 사건마다 다를 수 있습니다. 예를 들어 다음과 같은 부분을 다시 볼 수 있습니다.
- 여행 목적과 귀국·재입국 계획이 불명확한 경우
- 현재 고용 또는 학업 상황과 신청 내용이 맞지 않는 경우
- 과거 신청서와 현재 신청서의 정보가 불일치하는 경우
- 가족관계·재정·여행 이력 설명이 충분하지 않은 경우
- 범죄경력 또는 다른 입국불허 이슈가 있는 경우

따라서 “나는 이미 캐나다에서 합법적으로 일하고 있으니 TRV는 당연히 나와야 한다”는 접근은 맞지 않습니다.
거절 후 바로 같은 내용으로 다시 신청해도 되나요?
새 TRV 신청 자체가 가능한 상황이라도 같은 신청서를 그대로 다시 제출하는 것과 거절 원인을 확인한 뒤 보완하여 재신청하는 것은 다릅니다.

Reconsideration이 나을까요, 재신청이 나을까요?
모든 TRV refusal에 정식 appeal이 있는 것은 아닙니다. 그래서 실무적으로는 재신청, reconsideration 요청, 기록 확인, 경우에 따라 다른 법적 절차의 필요성을 구분해야 합니다.
Reconsideration은 단순히 “결정에 동의하지 않는다”는 이유만으로 다시 심사해 달라는 절차로 생각하면 안 됩니다. 명백한 사실오인, 절차적 문제 또는 제출된 핵심자료를 잘못 이해한 정황이 있는지와 같은 구체적 근거가 중요합니다.
반대로 거절의 핵심이 부족한 증빙이나 설명의 약점이라면, 같은 기록으로 reconsideration만 반복하기보다 새 신청에서 문제를 실제로 보완하는 쪽이 더 현실적일 수 있습니다.
어느 쪽이 맞는지는 refusal letter 한 장만이 아니라 이전 신청기록 전체를 본 뒤 판단해야 합니다.
이미 항공권을 샀다면 무엇부터 확인해야 하나요?
TRV 거절 후 출국 일정이 가까운 경우에는 다음 순서로 점검하는 것이 실무적입니다.
- 현재 캐나다 내 신분 — Work Permit 또는 Study Permit이 실제 유효한지 확인합니다.
- 거절의 범위 — TRV만 거절된 것인지, inadmissibility·misrepresentation·Permit cancellation 문제가 같이 있는지 봅니다.
- 여행서류 — 본인 국적과 여행경로상 TRV 또는 eTA가 필요한지 확인합니다.
- 재입국 시점 — Permit 만료일과 여권 유효기간을 함께 봅니다.
- 새 신청 전략 — 거절 사유가 보완 가능한지, 어떤 새 자료가 필요한지 정리합니다.

If you are inside Canada with a valid work permit or study permit and your new Temporary Resident Visa (TRV) application is refused, the first step is to separate two different issues: your present authorization to stay, work or study in Canada and the travel document you may need to leave Canada and return. A TRV refusal does not, by itself, mean that every valid permit has automatically been cancelled, but a refusal involving misrepresentation, inadmissibility or a separate permit-cancellation issue requires a much broader review.
Key answer: A refusal of a separate TRV application does not, by itself, automatically invalidate a still-valid work permit or study permit. The practical problem is often travel: without the required TRV, a visa-required foreign national may not be able to return to Canada after leaving. If the refusal also raises inadmissibility, misrepresentation or a separate cancellation issue, the person's present status and permit must be reviewed independently.
A work permit, study permit and TRV do different jobs
A common mistake is to treat a Canadian permit and a visa as the same document.
- A work permit authorizes work in Canada subject to the conditions printed on or attached to the permit.
- A study permit authorizes studies in Canada subject to the applicable conditions.
- A TRV or visitor visa is a travel document used by visa-required foreign nationals to travel to Canada and seek entry.
IRCC expressly states on its in-Canada visitor visa page for workers and students that a work permit or study permit is not a visa. Extending a permit does not automatically extend a TRV.

This is why it is incorrect to assume that a TRV refusal automatically means the work or study permit has been refused. It is equally risky to assume that a valid permit alone allows unrestricted international travel.
Does a TRV refusal automatically cancel a valid work permit?
As a general rule, the refusal of a separate TRV application is not itself an automatic invalidity event for a valid work permit.
Section 209 of the Immigration and Refugee Protection Regulations states when a work permit becomes invalid, including expiry and cancellation under specified regulatory provisions. A refusal of a separate TRV application is not listed as an automatic invalidity event under section 209.

Study permits have their own rules. Section 222 addresses events that can make a study permit invalid, including the 90-day rule after completion of studies, no longer being enrolled at the named designated learning institution in certain circumstances, cancellation and expiry.

The key point is that a TRV refusal and permit validity are not the same legal question.
However, a refusal must be reviewed more carefully if the decision or any accompanying correspondence raises issues such as:
- inaccurate information or material omissions in a prior application
- possible misrepresentation
- criminal, medical or other inadmissibility
- a separate notice cancelling an existing permit
- non-compliance with current immigration status or permit conditions
- removal or enforcement issues
In those circumstances, the statement “only the TRV was refused” may not capture the full problem. The entire refusal package and any separate notice should be reviewed.
Can you keep working or studying while you remain in Canada?
If the work permit or study permit remains legally valid, there has been no separate cancellation or loss of status, and the person continues to comply with all applicable permit conditions, a TRV refusal alone does not necessarily require them to stop working or studying immediately.
Temporary resident status is not determined only by the expiry date printed on a visa counterfoil. Section 183 of the IRPR governs general conditions and the period authorized for a temporary resident's stay.

A person should still verify:
- the expiry date of the current permit
- employer, occupation or location conditions on an employer-specific work permit
- DLI enrolment and study-permit conditions
- whether maintained status actually applies if a permit extension is pending
- whether IRCC or CBSA issued any separate letter affecting status or the permit
Do not rely only on the printed expiry date. In some circumstances a study permit can become invalid before that date, and a work permit can also be cancelled under the Regulations.
The biggest practical problem is leaving Canada and trying to return
For many people, the immediate consequence of a TRV refusal is not their day-to-day status inside Canada. It is the inability to travel abroad and return as planned.
IRCC states that a work permit is not a travel document. Depending on nationality and the method of travel, a person may need a valid TRV or an eTA to return to Canada.

The worker may still need to assess whether the current permit and status remain valid inside Canada. But if the worker leaves for Korea or another country, a visa-required traveller may not be able to board a flight or return through the normal process without a valid TRV.
Valid study permit, but no valid TRV
The same distinction applies. A study permit is permission to study; it does not replace a required visa for travel back to Canada.
Travel is unavoidable
Before finalizing travel, review the travel document required for the person's nationality, the TRV refusal reasons, the possibility of a new application, the travel date and the permit expiry date together. A valid permit should not be treated as a guarantee of return.
What about the limited United States or Saint-Pierre-et-Miquelon exception?
The IRPR contains a narrow visa exemption that may apply to certain temporary residents returning directly after a visit solely to the United States or Saint-Pierre-et-Miquelon. Among other requirements, the person must have held the relevant work permit or study permit before leaving Canada and must return before the end of the period authorized for their stay.
This is not a general rule allowing a visa-required permit holder to travel anywhere without a TRV. The itinerary, authorized stay, passport and permit conditions must all be examined carefully.
A person who has just received a TRV refusal should therefore not assume that a short trip to the United States is automatically safe without first confirming that every condition of the exemption is met.
Why can an in-Canada TRV application be refused even with a valid permit?
A valid work permit or study permit does not guarantee approval of a TRV.
IRCC provides a specific in-Canada TRV process for eligible workers and students who hold valid permits, but the visa application is still assessed separately.
The issues can vary from case to case and may include:
- an unclear travel purpose or return plan
- inconsistencies between current employment or studies and the application
- differences between past and current immigration forms
- insufficient explanation of family, financial or travel history
- criminal or other admissibility concerns
- incorrect answers about prior refusals, border incidents or immigration history in Canada or another country
The fact that a person is lawfully working or studying in Canada does not make the TRV automatic.
Should you immediately submit the same TRV application again?
A person may be able to file a new application, but simply resubmitting the same forms and evidence is different from making a new application that addresses the actual refusal concern.
Review at least:
- the complete TRV refusal letter
- any Officer Decision Notes provided with the refusal
- the previous TRV forms and every uploaded document
- the current work permit or study permit
- prior Canadian visa, permit and border history
- the passport and previous TRVs
- the planned travel itinerary
- any change in employment, studies, finances or family circumstances

Reconsideration or a new application?
There is no general statutory appeal for every TRV refusal. Depending on the circumstances, the practical options may include a new application, a reconsideration request, a record review or another legal remedy.
A reconsideration request should not be treated as a simple request for a different officer to agree with the applicant. It is more relevant where there is a concrete basis such as a material factual error, a procedural problem or a significant piece of evidence that appears to have been misunderstood.
If the refusal instead exposes a real weakness in the evidence or explanation, correcting that weakness in a properly prepared new application may be more practical than repeating the same position through reconsideration.
The correct choice depends on the complete prior filing, not only the one-page refusal letter.
What if you have already purchased a flight?
If travel is approaching, use a structured review:
- Current status in Canada — confirm that the work permit or study permit is actually valid.
- Scope of the refusal — determine whether only the TRV was refused or whether inadmissibility, misrepresentation or permit cancellation is also involved.
- Required travel document — confirm whether your nationality and itinerary require a TRV or eTA.
- Return date — compare the planned return date with the passport and permit validity.
- New application strategy — identify the refusal concern and the new evidence or explanation needed.
- Consequences of being unable to return — consider the impact on employment, studies and family before leaving Canada.
Both extremes are unsafe: assuming that a TRV refusal means you must immediately leave Canada, and assuming that a valid permit makes international travel irrelevant.
How is this different from a simple TRV expiry?

The present issue is different because the person actually applied for a new TRV and was refused. With a simple expiry, the focus is usually on obtaining a new travel document. After a refusal, the applicant should first determine why the visa was refused and whether that reason has any broader effect on permit validity or admissibility.
Final checklist
When a TRV is refused while a work or study permit is still valid, separate the questions of status and travel.
- A TRV refusal does not, by itself, automatically invalidate a valid work permit or study permit.
- Permit expiry, cancellation and compliance issues must be checked separately.
- A permit is not an ordinary travel document for re-entry.
- A visa-required traveller may need a valid TRV to return after leaving Canada.
- Misrepresentation, inadmissibility or a separate cancellation notice can change the analysis substantially.
- If travel is planned, review the refusal and the ability to return before leaving Canada.
