실직과 스폰서 자격은 같은 문제가 아닙니다

스폰서가 직장을 잃었다고 해서 곧바로 “소득요건 미달”로 탈락하는 구조는 아닙니다. 일반적인 배우자초청에서는 부모·조부모 초청처럼 특정 기간의 최소소득을 반드시 충족해야 하는 방식이 적용되지 않는 경우가 대부분입니다.

  • EI 또는 기타 합법적인 소득원이 있는지
  • 저축, 배우자의 소득 또는 가족의 합법적인 지원이 있는지
  • 주거비와 고정비를 감당할 수 있는지
  • 장기간 실업 상태인지, 재취업 계획이 있는지
  • 과거 스폰서십 관련 채무나 정부에 상환하지 않은 금액이 있는지

중요한 것은 일정한 연봉 숫자를 맞추는 것보다 스폰서 자격 제한 사유가 없는지와 실제 생활지원 계획이 합리적인지를 보는 것입니다.

EI를 받는 것과 사회보조금을 받는 것은 다릅니다

여기서 가장 많이 혼동하는 부분이 EI입니다.

IRCC의 배우자초청 가이드는 Employment Insurance와 social assistance를 동일하게 취급하지 않습니다. 현재 공식 지침에는 maternity, parental, sickness benefits 등 Employment Insurance Act에 따른 특정 EI 급여를 받는 경우에도 스폰서가 될 수 있다고 안내되어 있습니다. 또한 regular Employment Insurance를 받고 있다는 이유만으로 스폰서 자격이 자동 박탈되는 것은 아니라고 설명합니다.

IRCC는 스폰서가 장애를 이유로 한 경우를 제외하고 social assistance를 받고 있지 않아야 한다고 명시하고 있습니다. 여기서 어떤 급여가 “social assistance”에 해당하는지는 지급 프로그램의 성격을 확인해야 합니다. 모든 정부 지급금이 자동으로 social assistance가 되는 것은 아닙니다.

배우자초청에도 최소소득 기준이 필요한 예외가 있습니다

즉, 가족구성이 단순한 부부 2명인지, 자녀와 손자녀 세대까지 포함되는지에 따라 요구사항이 달라질 수 있습니다.

또한 퀘벡에 거주하는 스폰서는 연방 IRCC 절차 외에 퀘벡의 별도 undertaking 및 자격요건을 확인해야 합니다. 퀘벡 신청은 연방 절차와 동일하다고 가정하면 안 됩니다.

이미 배우자초청을 제출한 뒤 실직했다면 무엇을 해야 할까요?

신청 후 실직했다고 해서 무조건 새로 신청하거나 기존 신청을 철회할 이유는 없습니다. 먼저 현재 신청에서 스폰서 자격이 계속 유지되는지를 확인해야 합니다.

1. 실직 경위와 날짜

5. 정부지원 종류 확인

이전 스폰서십 채무가 있다면 별도 문제입니다

현재의 실직 여부와 별개로, 과거에 초청한 사람이 undertaking 기간 중 social assistance를 받아 정부가 스폰서에게 상환을 요구했는데 이를 갚지 않은 경우에는 새로운 스폰서십에 문제가 될 수 있습니다.

또한 court-ordered child support 또는 alimony 미지급, immigration loan default, 이전 배우자에 대한 undertaking 기간 등도 스폰서 자격 판단에서 따로 확인되는 요소입니다.

따라서 “현재 직장이 있느냐”만 보는 것이 아니라 현재와 과거의 sponsorship default 전체를 확인해야 합니다.

흔한 실수

첫째, 실직하면 무조건 배우자초청이 불가능하다고 생각해 신청을 포기하는 것입니다. 일반적인 배우자초청은 대부분 특정 MNI를 요구하지 않습니다.

둘째, 반대로 “소득요건이 없으니 재정상태는 아무 상관없다”고 생각하는 것입니다. 스폰서는 undertaking을 지고 있으며 social assistance 제한과 기본생활 지원책을 확인해야 합니다.

Spousal Sponsorship After Job Loss: Can a Sponsor Apply While Receiving EI?

A Canadian citizen or permanent resident may lose a job while preparing a spousal sponsorship application or after the application has already been submitted. A common concern is whether unemployment, by itself, makes the sponsor ineligible.

In most cases, job loss does not automatically disqualify a spousal sponsor. Most applications to sponsor a spouse, common-law partner or dependent child are not subject to a fixed Minimum Necessary Income requirement. However, that does not mean finances are irrelevant.

A sponsor must still satisfy the sponsorship eligibility rules, must not be receiving social assistance for a reason other than disability, and must undertake to provide basic needs for the sponsored family member.

Unemployment is not the same as sponsor ineligibility

The ordinary spousal sponsorship framework does not generally require the sponsor to prove a particular annual salary. This is different from programs such as parent and grandparent sponsorship, where prescribed income requirements play a central role.

Still, a sponsor signs an undertaking and remains financially responsible for the sponsored person. If employment has ended, it is sensible to document how the household will meet basic needs while the sponsor is unemployed.

Useful evidence may include current bank statements, Employment Insurance records, a spouse's lawful income, savings, housing information, and evidence of a genuine re-employment plan where applicable.

The key issue is not whether the sponsor can show a perfect employment history. It is whether the sponsor remains legally eligible and has a credible plan to support the sponsored family member.

Employment Insurance is not the same as social assistance

This distinction is critical.

IRCC's current sponsorship guide states that a person may still sponsor while receiving maternity, parental or sickness benefits paid under the Employment Insurance Act. Regular Employment Insurance also does not, by itself, make a person ineligible to sponsor.

However, EI may be treated differently when an application falls into one of the limited situations where a minimum income requirement actually applies. Regular EI generally does not count toward the MNI calculation in the same way as certain special EI benefits.

Therefore, the correct analysis is not simply, “Are you receiving EI?” It is:

  • What type of EI are you receiving?
  • Does your specific sponsorship require MNI?
  • What other income or financial resources are available?
  • Are you receiving any separate benefit that is actually social assistance?

Social assistance is the more direct eligibility issue

IRCC requires a sponsor to prove that they are not receiving social assistance for a reason other than disability.

Not every government payment is “social assistance.” EI, tax benefits and provincial welfare programs should not be treated as interchangeable. The exact program name, the authority paying it and the legal basis for the payment matter.

If the sponsor is currently receiving welfare or another program that may constitute social assistance for a non-disability reason, sponsor eligibility should be reviewed before the application is filed or before assuming that an application already in process is unaffected.

When can a minimum income requirement apply?

There are limited family configurations in which an income threshold can apply even in spouse or dependent-child sponsorship.

IRCC explains that a minimum income requirement may apply, for example, where a spouse or partner being sponsored has a dependent child who, in turn, has a dependent child of their own.

This is why the phrase “spousal sponsorship has no income requirement” should not be applied mechanically to every family structure.

What if the sponsor loses a job after submission?

A job loss after filing does not automatically mean the application must be withdrawn or resubmitted. The first step is to determine whether the sponsor remains eligible.

It is useful to organize:

  1. the date and reason employment ended;
  2. any Record of Employment or termination documentation;
  3. the exact type of EI or other benefits being received;
  4. current savings and other lawful household income;
  5. housing and recurring expenses;
  6. any new employment offer or genuine job-search plan; and
  7. any prior sponsorship debts or defaults.

Do not create or exaggerate a future employment plan. The objective is to present the current financial circumstances accurately and consistently.

Previous sponsorship debts are a separate problem

Even if current unemployment is not disqualifying, a sponsor may be ineligible if a person previously sponsored received social assistance during an undertaking period and the resulting debt has not been repaid.

Other issues can include unpaid court-ordered support, default on certain immigration loans, or an existing undertaking for a previously sponsored spouse or partner.

Sponsor eligibility therefore requires more than checking whether the person currently has a job.

Common mistakes

One mistake is assuming that unemployment automatically makes sponsorship impossible.

The opposite mistake is assuming that because most spousal sponsorships have no MNI, financial circumstances never matter.

Another common error is treating EI and provincial welfare as the same benefit. They are not. The benefit must be identified precisely.

Finally, Quebec residents should not rely solely on the federal rules because Quebec has its own sponsorship undertaking process.

Practical checklist

Before filing or responding to a change in circumstances:

  • identify every government benefit the sponsor currently receives;
  • distinguish regular EI from maternity, parental or sickness EI;
  • confirm whether any benefit is social assistance;
  • check whether the family structure triggers an MNI exception;
  • organize savings, housing and household-support information;
  • review any prior sponsorship debt or other default; and
  • confirm whether Quebec rules apply.
