IRCC Guide 5552
English Version
My study permit expired. Can I keep studying if I apply for restoration within 90 days?
Applying for restoration does not, by itself, authorize you to continue studying after losing student status. Restoration differs from maintained status following a timely extension application. The usual 90-day restoration deadline is not an additional period of authorized study. IRCC: expired study permits
Tuition may already be paid and next term's timetable arranged when a student discovers an expired permit. Before filing another application, identify the actual date status was lost, whether anything was submitted before expiry, and whether study or work has continued.
1. Distinguish a timely extension from a late application
A properly submitted extension application before expiry may allow a student remaining in Canada to maintain status and continue studying under the applicable existing conditions. If the permit expired without an extension application, restoration may need to be considered. Saving an application in an online account or paying fees is not the same as submitting it.
An application returned as incomplete must also be distinguished from one refused after assessment. IRCC states that an incomplete application is treated as never submitted and does not support maintained status. Review submission records and the actual return or refusal notice rather than relying on the date the form was prepared. IRCC Guide 5552
2. Identify the correct starting date
The ordinary restoration window is 90 days after loss of status. Do not automatically assume the printed permit expiry date is the only relevant date.
A study permit expires on the earlier of its printed expiry date and 90 days after completion of studies. Completion can be established by the school's first notification, including an email, letter or transcript; the graduation ceremony may occur later. IRCC: when a study permit expires
In a hypothetical example, a permit showing a December expiry cannot safely be relied on until December if the program was completed sufficiently earlier. Conversely, a timely extension application requires assessment of its effect on status. The 90 days following program completion and the 90 days for restoration after loss of status are different rules.
3. What about classes and employment while waiting?
IRCC explains that an eligible restoration applicant may remain in Canada while the application is processed, but cannot resume studying until student status has been restored and a new study permit received. Approval is not guaranteed. IRCC restoration guidance
Any employment authorization dependent on student status needs separate review. A school's willingness to accept enrolment or an employer's instruction to report for work does not create immigration authorization. If study or work continued after expiry, record the dates and hours accurately.
4. Prepare a clear chronology and supporting records
Useful consultation materials include current and previous permits, passport validity, submission confirmations, receipts, return or refusal notices, enrolment records, transcripts and completion notifications. Also prepare a factual account of when the problem was discovered, any subsequent study or work, the proposed academic plan, financial records and each accompanying family member's status documents.
These are consultation materials, not a universal application checklist. The actual documents depend on the case and current IRCC requirements. An explanation should connect dates, events and evidence instead of simply stating that the deadline was forgotten. Family members who also lost status may need their own applications and fees. IRCC restoration requirements
5. Compare three hypothetical situations before choosing a route
These examples are illustrative, not client success stories. Three students can all hold permits whose printed expiry dates have passed while requiring different assessments.
| Situation | Records to examine first | Assumption to avoid |
|---|---|---|
| A submitted an extension before expiry and is awaiting a decision | Submission confirmation, existing conditions and presence in Canada | Assuming restoration is necessarily required because the printed date passed |
| B only started an application after expiry | Actual loss of status, timing and current activities | Treating a new submission as immediate permission to study |
| C applied before expiry but received an incomplete-application notice | Submission record, return reasons, notice and original expiry | Assuming the earlier application remains effective until resubmission |
The point is to identify the correct problem before selecting a form. For C, the important issue is how the application is treated, not simply the recollection that something was filed. Prepare the complete notice for review, with unnecessary personal information removed from an initial inquiry, rather than relying on its subject line.
6. Coordinate an academic plan with the school
Contact the international student office and the academic department to establish how an interruption affects enrolment and the earliest realistic return date. Deferral, tuition credit or refund, required placements and residence arrangements may be handled by different offices. Keep a separate list of their deadlines so an immigration problem does not also cause avoidable academic or contractual difficulties.
A useful email identifies the current term, last attendance date, next term's start and specific questions. Ask what options exist if the immigration decision has not arrived by registration day. Do not promise an approval date. Retain written responses and compare the dates and program names on newly issued school documents with the application record. Academic arrangements help establish a workable plan; they do not replace immigration authorization.
7. Build an evidence-based explanation
Before drafting a letter, create a single-page chronology. Separate what happened, when it happened, how it is documented and what remains uncertain. Check original emails or account records instead of filling gaps from memory.
| Topic | Example records | Drafting caution |
|---|---|---|
| Permit and program timeline | Permit, academic schedule, completion notification | Distinguish the ceremony from the completion notification |
| Application attempts and outcome | Submission confirmation, receipt, IRCC notice | Do not merge preparation, payment and submission |
| Activities after expiry | Attendance, work records, correspondence | Do not omit periods because they appear unfavourable |
| Proposed next steps | Return schedule, tuition and living-expense records | Identify arrangements that remain unconfirmed |
A long apology or a copied explanation cannot substitute for this factual work. The reason given, supporting evidence and present actions should fit together. This organization is a practical consultation suggestion, not a prescribed form or formula for approval.
8. Track family documents and practical commitments separately
Create one row for each accompanying family member showing the document type, expiry, applications already filed and current activities. Avoid treating one person's submission confirmation as evidence that everyone in the household has the same position. The status review should account for each person's own record.
Maintain a second list for passport renewal, housing, insurance and tuition deadlines. Where possible, keep arrangements flexible instead of making firm travel or return-to-class commitments around an assumed processing date. If departure is being considered, obtain advice on its effect on the application and on the documents and authorization needed for a later return. A trip outside Canada should not be treated as an automatic solution. Restoration, permission to enter and the school's ability to readmit a student involve different questions.
9. Check the common misconceptions
Does paid tuition authorize attendance? Payment is useful evidence of academic arrangements and finances, but does not substitute for permission to study. Discuss available tuition and enrolment options with the school.
Is a fee receipt proof of submission? Check it against the actual submission confirmation. A saved application, uploaded file or payment screen alone is not enough to establish the full procedural history.
Can I copy a friend's explanation? Students at the same school can have different completion dates, application histories and work records. Describe your own facts and support them with your own evidence.
Does restoration settle future PGWP eligibility? Do not combine restoration and post-graduation work permit eligibility into one conclusion. The academic history and future plans require their own assessment. Plan beyond submission day: identify the program you intend to continue, the realistic return arrangements and the records you will need to retain.
10. If more than 90 days have passed
Do not assume an ordinary restoration application will resolve the situation after the general deadline. Departure, an application from outside Canada and any genuinely applicable special policy need assessment. Another person's exception may not apply.
For a preliminary inquiry, tell Yujin Visa Immigration whether you are currently in Canada, your permit expiry date, whether an application was submitted before expiry and what notices you received. Start with a summary rather than sending sensitive documents in full. Study permit services · Contact
